Twilio has agreed to pay $10 million to settle class action claims that they violated California call recording laws.
There are two settlement Classes, each including consumers who made or received a phone call or sent or received a text message, relating to an account with Homejoy, Handy, or Trulia, that was recorded by Twilio. Various dates apply to each situation. More details are available in the “Who’s Eligible” section below.
California has some of the strictest privacy laws in the country and the state’s constitution considers the right to privacy to be an inalienable right. California call recording laws reflect the state’s attitude on the right to privacy and protect consumers from businesses recording phone calls without consent.
Twilio allegedly violated the California Invasion of Privacy Act by recording phone calls for Handy and Homejoy and recording text messages for Trulia.
Plaintiff Angela Flowers argued that she and other consumers were not warned that their calls and texts would be recorded.
Twilio has denied any wrongdoing despite settling the class action claims. Instead, the settlement will provide resolution to all parties and will allow them to avoid the costs and risks of litigation.
Under the settlement, consumers who had a phone call record will receive an estimated payment of $64.30. Consumers who had only a text message recorded will receive an estimated payment of $8.04. These estimates may not be the final value, depending on settlement awards.
In addition to monetary payments, Twilio has agreed to update its policy to make sure its customers get legal consent before using the company’s recording service.
Class Members are not required to file a claim to receive payment from the settlement.
The exclusion deadline for the settlement in April 30, 2019. The objection deadline for the settlement is also April 30, 2019.
Who’s Eligible
The CIPA § 631 Class: All persons who, while in California either:
- made or received a phone call that Twilio recorded for an account linked to Homejoy between April 21, 2010 and March 31, 2016;
- made or received a phone call that Twilio recorded for an account linked to Handy between April 21, 2010 and June 29, 2017;
- sent or received a text message that Twilio recorded for an account linked to Homejoy between April 21, 2010 and March 31, 2016;
- sent or received a text message that Twilio recorded for an account linked to Trulia between April 21, 2010 and April 26, 2018; or
- sent or received a text message that Twilio recorded for an account linked to Handy between April 21, 2010 and April 25, 2016.
The CIPA § 632.7 Class
: All persons who, while in California and using a cell phone either:
- made or received a phone call that Twilio recorded for an account linked to Homejoy between April 21, 2010 and March 31, 2016;
- made or received a phone call that Twilio recorded for an account linked to Handy between April 21, 2010 and June 29, 2017;
- sent or received a text message that Twilio recorded for an account linked to Homejoy between April 21, 2010 and March 31, 2016;
- sent or received a text message that Twilio recorded for an account linked to Trulia between April 21, 2010 and April 26, 2018; or
- sent or received a text message that Twilio recorded for an account linked to Handy between April 21, 2010 and April 25, 2016.

Well today is May 22 2020 and I recieved a $9.23 check I deposit it next week
I got a chq but BOA says account unlocatable.
I got charged a fee too.
I got my post card check only $9.23

I got a post card check for $9.23. Void after Dec 16, 2019.
Didnt know for what. Would rather be reimbursed for my citys corrupt sanitary sewer collection system that blocked my main but doesnt take responsibility for the back up and so Im out almost $600.00. The Plumber was probably happy but mentioned it was the citys fault too and thats all he has been dealing with.

I received a very small check which is not a standard check yesterday. Wondered if I can electronically deposit it via my bank app? In the back of the check, there is no endorsement section or signature section. It is actually my mailing address. Can I deposit it? Thanks!
