Couple Claims Verizon Unwanted Calls Broke Federal Telemarketing LawsA woman says she received spam phone calls from Wells Fargo even though she has never had any business relationship with that bank.

This lawsuit was filed against Wells Fargo Bank on Oct. 25, 2018 by plaintiff Lisa B., a citizen and resident of Holland, Mich. She alleges that she was the recipient of multiple spam cell phone calls from the defendant starting in 2016.

The spam cell phone calls, according to the narrative of the Wells Fargo lawsuit, had no basis in an established business relationship with Lisa as such a connection did not exist.

In addition to making the claim that she had no current business relationship with the financial institution at the time the spam cell phone calls began, Lisa also claimed that she never had been a customer of them or given bank representatives any permission to contact her in this manner.

Lisa says that the spam cell phone calls began in 2016. The legal complaint registers at least three calls of which she made precise records that originated from three separate phone numbers.

When she dialed these phone numbers back individually, she alleges the greeting identified two out of three of them as Wells Fargo numbers.

Lisa says that when the bank was incessantly calling her, they would leave messages for a person unknown to the complainant by the name of Richard Loutman. Lisa says she made every attempt to reach the source of the Wells Fargo spam cell phone calls by occasionally answering them and speaking to an agent. She says she informed them that she didn’t know the person whom they were seeking, and she allegedly asked them to stop calling.

Lisa also claims that when this did nothing to stop the bank from making these phone calls, she actually went into a local branch to speak with someone. This effort was also of little effect, she says.

The plaintiff allegedly continued to receive harassing robocalls to her cell phone that she alleges invaded her privacy, and were a source of constant nuisance and intrusion which affected her mental state. She claims that her cell phone, for which she pays in a monthly plan, was also tied up by the calls with no thought by the defendant of her personal cost.

Lisa filed her legal complaint on behalf of herself and as a would-be representative of a Class of persons who have received like phone calls from Wells Fargo beginning on March 31, 2016 and extending to the date of class certification.

These recipients must be non-customers of the bank that were contacted with regard to an automobile loan. The spam phone calls must have been made to a mobile telephone number using an Automated Telephone Dialing System (ATDS) and/or have left pre-recorded automated messages.

Lisa alleges that this activity is inherently in violation of the Telephone Consumer Protection Act (TCPA). The TCPA was passed in 1991 and very strictly prohibits the use of ATDS and pre-recorded messages that are of a non-emergent nature and are placed without the express permission of the recipient. It is also against the law to direct these communications toward any telephone service, such as a mobile line, in which the recipient must actually pay to be contacted.
