A $611,600 class action settlement resolves claims that Employment Background Investigations violated the Fair Credit Reporting Act by providing criminal history information to employers without notifying consumers.

The Employment Background Investigations settlement benefits individuals who were the subject of a consumer report the company prepared that reported criminal record information between Nov. 17, 2021, and March 21, 2022.

The settlement also benefits a subclass of consumers who are eligible for automatic payments. The automatic payment class includes individuals who were the subject of a consumer report EBI prepared that reported criminal information between Nov. 17, 2021, and March 21, 2022, in which the individuals later disputed the inclusion of criminal record information with EBI. Members of the automatic payment class do not need to file a claim to benefit from the settlement.

According to the EBI class action lawsuit, the consumer report company failed to send notice to individuals about the criminal history information included in the reports. This failure to notify allegedly violated the FCRA.

EBI is a consumer reporting agency Sterling owns that provides background checks and other services to employers.

Under the terms of the Employment Background Investigations settlement, class members can receive an equal payment estimated at about $600. Payments will vary depending on the number of participating class members. 

The objection and exclusion deadline was Sept. 14, 2024. 

The final approval hearing for the EBI class action lawsuit settlement was scheduled for Oct. 29, 2024. 

The claim form deadline is Dec. 7, 2024. Class members who are not eligible for automatic payments must submit a valid claim form by this date.
