Flo App Data Privacy Class Action Lawsuit Overview:
- Who: Flo Health Inc.
- What: Flo Health has been hit with a third lawsuit alleging it illegally sold personal consumer information from its menstrual app Flo to third parties, including Facebook and Google.
- Where: The class action lawsuit was filed in California, but has nationwide implications.
Flo, the maker of an app that tracks periods and collects sexual health information, has been hit with another class action lawsuit alleging it shared private consumer information with Facebook, Google and others, despite promising it wouldn’t.
The complaint against Flo Health Inc. was filed last Thursday in a California federal court by plaintiffs from seven different class action lawsuits lodged against the company earlier this year, Reuters reports.
The class action lawsuit follows a settlement Flo Health reached with the Federal Trade Commission (FTC) in January, made after the FTC filed a similar complaint against Flo Health’s app last year.
Last Thursday’s complaint alleges that users of the app give Flo Health intimate personal information, including about their sexual histories, in order to use the app.
Flo Health makes public assurances and publishes privacy policies advising consumers it will not share this private information, the class action stated. However, the class action claims the app violates user privacy by disclosing their information to third parties through software development kits incorporated into the app.
Facebook and Google Also Named as Defendants in Privacy Class Action Lawsuit
The lawsuit also names Facebook, Google and two data analytics companies, Flurry and AppsFlyer, as defendants.
It says the other defendants allegedly “knew that the data collected and received from Flo Health included intimate health data” but didn’t do anything about it because the data is “vital to their business.”
The plaintiffs are suing Flo for invasion of privacy, breach of contract, and violation of the federal Stored Communications Act.
The lawsuit accuses the other defendants of “aiding and abetting” Flo Health’s alleged practices, among other claims, including a Federal Wiretap Act claim against Facebook, Google and Flurry.
The latest class action lawsuit follows a similar filing in February claiming Flo breaks agreements with its users, violates medical confidentiality laws in California and unjustly profits by doing so.
