A $28 million Wells Fargo settlement resolves class action lawsuit claims that call recordings were made without the recipient’s consent.
The Class includes all businesses that received a phone call from a call center operated by International Payment Services LLC or one of its affiliates between March 7, 2011, and May 7, 2014, while the call recipient was physically in California, and who did not sign a contract for merchant processing services with First Data Merchant Services LLC.
Plaintiffs in a 2016 class action lawsuit alleged International Payment Services recorded certain calls to businesses in California on behalf of Wells Fargo and First Data Merchant Services without disclosing that the call was being recorded — a violation of the California Invasion of Privacy Act (CIPA).
Wells Fargo denies all allegations of wrongdoing, and the Court has not ruled in favor of either party in this case.
The bank reported having about 69 million customers as of June 2021.
Class Members in the call recordings settlement who choose not to exclude themselves from the class action lawsuit will be eligible for a cash payment for each eligible call covered under the Class definition.
The exact amount of each payment is not known at this time.
The minimum payment for each eligible call is expected to be about $40, but could be up to $5,000 per call depending on the number of claims submitted.
A final approval hearing in the Wells Fargo settlement is scheduled to take place Dec. 6, 2021.
The deadline to ask to be excluded from or to object to the settlement is Oct. 25, 2021.
The claim deadline is Nov. 1, 2021.
