Paychex has agreed to pay nearly $3.4 million to benefit individuals who used one of the company’s biometric timeclocks in Illinois.

The Class includes anyone who scanned their finger, iris, face, or other biometric identifier into a Paychex timeclock in Illinois between Jan. 7, 2014, and May 28, 2021.

A list of Paychex biometric timeclocks covered by the settlement can be found on the settlement website.

A class action lawsuit alleged Paychex violated the Illinois Biometric Information Privacy Act (BIPA) by collecting people’s biometric identifiers via finger, iris, or facial scans without providing the required written disclosures or obtaining written consent.

Paychex provides payroll, human resources, and other services to more than 680,000 clients in the United States and Europe, according to its website, and pays 1 in 12 private-sector employees in the United States.

Paychex denies all allegations of wrongdoing, but has agreed to the settlement.

Class Members who file a valid claim in the Paychex settlement will receive a proportionate share of the $3,375,519 settlement fund after attorneys’ fees and other expenses are deducted.

The exact amount of each Class Member’s payment is unknown at this time and will be determined by a number of factors, including the total number of valid claims filed.

A final approval hearing in the Paychex settlement is scheduled for Sept. 9, 2021.

Requests for exclusion from and objections to the settlement must be submitted by Aug. 6, 2021.

The claim deadline is Aug. 27, 2021.

Anyone who scanned their finger, iris, face, or other biometric identifier into a Paychex timeclock in Illinois between Jan. 7, 2014, and May 28, 2021.
