Yaz Lawsuits Keep Coming

Women who are trying to prevent pregnancy have several methods of contraceptives to turn to. One of the more common birth control pills that were taken by women is known as Yaz – or Yasmin. Yaz was first approved for use by the FDA in 2006 as a treatment for acne, Premenstrual Dysphoric Disorder (PDD) and as a method of birth control. Since its approval, more than 10,000 Yaz lawsuits have been brought against the German manufacturer, Bayer. Among the many Yaz side effects that are prompting the Yaz lawsuits include strokes and blood clots as well as other serious injuries.
FDA Prompts Stronger Warning Labels in 2008
After reports of several thousand injuries, the FDA ordered Bayer to strengthen the warning labels that existed on Yaz packages. The warning label that exists today is the most serious one that the FDA uses – the black-box warning. Women who smoke are urged to consider the Yaz side effects that may occur should they smoke while using Yaz.
Scientific Studies Prove Yaz Link to Increased Blood Clots
While many women suffering from extensive damage caused by blood clots in the lungs, brain and heart can link their symptoms to the consumption of Yaz, recent studies have proven that the link does exist. It is widely speculated that these studies are the reason for Bayer initiating settlements among the first round of Yaz lawsuits.
Studies prove that women who chose to use Yaz were subjected to twice as much risk in terms of developing blood clots than those who used older birth control pills on the market.
Among the charges that Bayer is facing is the fact that they did not perform adequate research on Yaz and they failed to issue a recall when reports indicated that there was a life-threatening risk in terms of Yaz side effects. Other similar charges include fraud and deceit as well as fraudulent concealment, breach of express and implied warrantees.
Over 3,500 Yaz Lawsuits Settled to Date
The most recent information that has been released in terms of Yaz and Yasmin settlements reveals that over 3,500 lawsuits have been settled with most settlement amounts hovering near the $250,000 mark. The first round of settling the Yaz lawsuits is focusing on those women who have experienced minor injury as a result of Yaz side effects.
Those who have experienced more serious injuries – including death – will likely settle for much more than the $250,000 average, with some Yaz lawsuits leading into the millions of dollars.
Ocella, the generic version of Yaz, was not considered part of the legal proceedings until recently when Bayer agreed to settle Ocella lawsuits as part of the ongoing Yaz lawsuits and Yasmin lawsuits.
