Stroke Victim Sues Birth Control Maker

By Andrea Gressman

Yaz, Yasmin, Ocella & Beyaz birth controlA new birth control lawsuit was filed on December 12, 2012 by a plaintiff claiming she suffered a stroke as well as other significant injuries caused by the synthetic hormone drospirenone, an ingredient used in the popular birth control pills Yasmin, Yaz, Beyaz and Ocella.

Plaintiff Brenda Depperschmidt alleges in the product liability lawsuit that the manufacturer of her birth control pill “willfully deceived” the medical community, the plaintiff, and the general public by not revealing the side effects of drospirenone, which include:

  • Blood clots
  • Deep vein thrombosis
  • Pulmonary embolism
  • Stroke

The drospirenone lawsuit goes on to claim that if Depperschmidt had been warned about these risks, she would have chosen a different birth control option. However, because the manufacturer chose to conceal these severe side effects, Depperschmidt experienced a stroke, making the drug manufacturer liable for her injuries.

Depperschmidt alleges in the lawsuit that she experienced physical injuries that are permanent in nature and has gone through a tremendous amount of pain and suffering, has “diminished enjoyment of life,” and suffered from mental anguish because of the drospirenone side effects she experienced. The lawsuit goes on to state that the plaintiff will now need ongoing medical treatment. This includes regular monitoring as well as physical therapy. The plaintiff also describes the economic loss she has experienced due to loss of income and medical expenses.

Depperschmidt is seeking compensation in the form of general, exemplary, and punitive damages. She also seeks restitution and injunctive relief.
