Plaintiff Claims Damaging Yaz Side Effects Will Shorten Her Life
By Christina Drury
A Florida resident filed a lawsuit against the makers of Yaz birth control on January 8, 2012, alleging that Bayer and its related entities manufactured and sold Yaz and Yasmin without providing proper warnings regarding the dangers associated with the pills. The plaintiff alleges the medication caused her to suffer from cardiac arrhythmia, stroke and pulmonary embolism and also caused her to have her gallbladder removed.
Plaintiff Sought Doctor Advice about Yaz
The plaintiff began using Yaz on the recommendation of her OBGYN, taking the birth control medication from 2007 through 2010. The lawsuit states that the adverse side effects the plaintiff suffered were directly caused by the use of the pills. The plaintiff claims the injuries and disabilities she sustained are permanent and will require long-term care. She asserts she did not realize that her injuries and health problems that have required hospitalization and the subsequent removal of her gallbladder were linked to the use of Yaz until long after she became severely ill.
Yaz Lawsuit Could Potentially Join MDL
The allegations against Bayer include negligence of the duty to adequately warn the medical community and the public of the potentially harmful side effects of Yasmin and Yaz. The plaintiff is seeking compensation for loss of earnings, mental anguish, shortened life span, disfigurement, hospital expenses and pain and suffering. This lawsuit may be added to the Yaz multidistrict litigation that is currently pending in the U.S. District Court for the Southern District of Illinois. Bayer has already negotiated several Yaz settlements in this MDL for millions of dollars outside of court.
Fourth-Generation Birth Control Pills Pose Risks
Fourth-generation oral contraceptives such as Yaz, Yasmin and the generic version known as Ocella, have been advertised and marketed as superior to their older counterparts. The hormone found in the newer birth control medications is known as drospirenone and is accompanied by a different set of side effects from older contraceptives. Documents filed with the courts indicate that since Yaz has been introduced to the public there have been hundreds of reports to the FDA of severe injuries and even deaths associated with the drug. Health problems that have been linked to the use of Yaz, Yasmin and Ocella include deep vein thrombosis, gallbladder disease, kidney disease, atrial fibrillation, hyperkalemia and stroke.
Bayer Has Not Issued Recall, Despite Problems
Even with the hundreds of reports and evidence against the birth control medication, Bayer has yet to issue a recall of Yasmin or Yaz. If you or someone you know has taken Yaz, Yasmin or Ocella and has suffered from any severe injuries, you may be entitled to receive compensation.
