Five additional Actos bladder cancer lawsuits have joined the 115 other Actos lawsuits previously filed in the Judicial Council Coordinated Proceedings in the Los Angeles Superior Court.
A wrongful death Actos lawsuit was recently filed against the major pharmaceutical company, Takeda Pharmaceutical, representing the family members of 5 people who claimed in their Actos lawsuits that their loved ones died of bladder cancer resulting from the use of the diabetes drug Actos.
The Actos bladder cancer lawsuit claims the plaintiffs took the Type II diabetes drug and suffered severe side effects, including bladder cancer, mental anguish, pain and suffering, economic loss, impaired body functions, reduced enjoyment of life, and eventually death.
Plaintiffs in the Actos lawsuits make the following accusations:
* Negligence
* Concealment with intent to deceive
* Failure to disclose pertinent warnings
* Defective design
* As well as other allegations
The Actos lawsuit against the Actos manufacturer, Takeda Pharmaceuticals, as well as its subsidiaries indicated that the defendants withheld information regarding the link between Actos and bladder cancer — information which they kept a secret for over a decade and even prior to filling out its original application in 1999.
Instead of publicizing the side effect risk to Actos plaintiffs, their doctors, and the public in general, Eli Lilly and Takeda did not come forward regarding the potential dangers and risks regarding the potentially deadly side effects of Actos, including bladder cancer, nor did they disclose knowledge that they did not study the drug or test it completely regarding that particular risk, plus they knowingly chose to ignore any links between the use of the drug, Actos, the pioglitazone hydrochloride and the side effect risk for potential development of bladder cancer.
Over the last decade, an influx of scientific data has proven true the claim that links Actos to the side effect of bladder cancer. A 2011 French Actos study found a strong and link between the Type II diabetes drug and bladder cancer. The resulting study resulted in Actos being banned in both Germany and France.
Previously this year, the FDA issued a safety advisory warning in Canada. This was based on evidence revealing a potential elevated risk of blood cancer in patients who use Actos. This year, the FDA also issued a warning to patients that Actos was linked to elevated side effect risk of developing bladder cancer after 12 months of use.
