benicar-stomach-painA Kentucky resident recently filed a Benicar lawsuit against Daiichi Sankyo, alleging that the hypertension drug led to severe Benicar side effects as well as economic loss.

Plaintiff Greg P. began taking Benicar at the direction of his doctor in May 2006. After he began taking the drug to treat his high blood pressure, the Benicar lawsuit claims that Greg experienced a number of Benicar side effects raging from mild to severe.

Benicar Side Effects Allegations

According to Greg’s lawsuit as well as other similar Benicar lawsuits, Benicar side effects include a variety of gastrointestinal injuries, including the following:

  • Villous atrophy
  • Sprue-like enteropathy
  • Colitis
  • Kidney failure
  • Malabsorption
  • Malnutrition
  • Dehydration
  • Diarrhea
  • Vomiting/Nausea
  • Abdominal pain

Greg claims that these side effects are a direct result of taking Benicar and filed his Benicar lawsuit on multiple counts, including defective design, failure to warn, negligence, fraud, and breach of express and implied warranties.

In filing this Benicar side effects lawsuit, Greg hopes to gain some kind of compensation for the physical and financial harm he has suffered as a result of taking Benicar.

His lawsuit has been consolidated into multidistrict litigation, or an MDL, along with a number of similar Benicar lawsuits.

Benicar Lawsuit Information

Benicar (olmesartan medoxomil) is a hypertension drug manufactured by Daiichi Sankyo, Inc., and was approved by the U.S. Food and Drug Administration (FDA) in 2002.

Benicar is one of a number of olmesartan drugs that have been introduced to the market in recent years. Other olmesartan medications include Benicar HCT, Tribenzor, and Azor.

These drugs became popular almost immediately after being released onto the market, and by 2012, nearly 2 million people were filling prescriptions for these drugs each year.

However, despite its popularity, Benicar has also been linked in adverse event reports and lawsuits with a number of Benicar side effects including villous atrophy and sprue-like enteropathy.

In response to complaints about these side effects, the FDA warned on July 3, 2013 about Benicar’s association with problems like chronic diarrhea and severe weight loss, and approved a warning label that would include these side effects.

Benicar lawsuits like Greg’s allege that the pharmaceutical company either knew or should have known about the Benicar side effects linked with their drug, yet failed to warn the public and the medical community about these risks.

Lawsuits claim that Daiichi Sankyo may even be actively misleading their customers and the medical community about the safety and efficacy of Benicar and similar products, continuing to market the drug as if they did not know about the risks.

Plaintiffs claim that, given adequate warning about the possibility of these side effects, they would have chosen a safer alternative.
