New Beyaz Lawsuit Alleges Permanent Injuries

Beyaz lawsuit blood clotKelly Popich of Pennsylvania says that just days after taking the popular oral contraceptive Beyaz in 2011, a doctor diagnosed her with pulmonary embolism. She reportedly had no idea the birth control pill was linked to these side effects until after a 2012 U.S. Food & Drug Administration (FDA) safety warning update.

In a Beyaz lawsuit filed August 8, Popich says that she continues to suffer from problems relating to these Beyaz side effects, which are also found in other Bayer Healthcare Pharmaceutical products. Treatment for these disorders often requires months of treatment with blood thinners which carry their own dangers. The Beyaz side effects lawsuit attorney notes that Popich suffered “physical injury [and] physical … suffering, and is at an increased risk of future medical complications due to her acute bilateral pulmonary emboli.”

While the FDA required an update to the drug’s label in 2012, the Beyaz side effects lawsuit attorney notes that studies completed prior to Popich’s usage of the medication indicated a several-fold higher risk of blood clots and venous thromboembolism associated with Yaz, Yasmin and Beyaz when compared to an older oral contraceptive class that did not use a dual-hormone formulation. In addition, Bayer was castigated by the FDA for alleging a reduced adverse event profile regarding acne and weight gain.

As a result, Bayer spent $20 million on updated advertising to include new warnings about the oral contraceptives. In addition, after negotiations overseen by Judge David Herndon, more than 2,000 Beyaz lawsuits have been settled and will award about $200,000 per woman affected by Beyaz pulmonary embolism side effects. More than 10,000 Beyaz lawsuits are currently outstanding.

The Beyaz side effects lawsuit is Kelly J. Popich v. Bayer Healthcare Pharmaceuticals Inc., et al., Case No. 13-cv-10788, in the U.S. District Court for the Southern District of Illinois. It was filed directly into the ongoing multidistrict litigation In Re Yasmin and Yaz (Drospirenone) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2100, in the U.S. District Court for the Southern District of Illinois.
