Mirena Side Effects Caused Severe Pain, Lawsuit Says

Mirena side effects, crampsA new Mirena IUD lawsuit alleges that the intrauterine device causes serious health complications and was marketed fraudulently. It is seeking damages for the plaintiff, who had to have the IUD removed due to severe pain and cramping caused by Mirena side effects.

Plaintiff Ashley Brewer of Illinois is suing Bayer, the manufacturer of the Mirena IUD, over alleged complications stemming from the birth control implant. The Mirena IUD lawsuit was filed on July 26, 2013, in Illinois federal court.


The Mirena lawsuit alleges that Bayer has continued to market the IUD though the Department of Health and Human Services, via a program called “Mirena Simple Style Statement Program.” The program was a marketing method Bayer used to promote this type of birth control.

The Mirena IUD is a hormone-based contraceptive designed to be inserted into the uterus, where it will slowly released pregnancy-blocking hormones. The IUD is designed to stay in the body for more than five years, though a physician can remove it earlier if necessary. Despite its popularity, the Mirena IUD has been dogged by various lawsuits alleging serious complications, including some requiring surgical intervention remove the IUD.

Brewer’s Mirena lawsuit alleges that the presentation from Bayer both oversold the IUD and downplayed various side effects of Mirena. The program allegedly states that the IUD could be used not just as birth control, but also as a means of controlling weight gain and clearing up acne. The IUD is only approved as a form of birth control. Additionally, the Mirena lawsuit asserts that the promotional program omitted the safety warnings and other information about the risks of complications associated with Mirena IUD side effects.

Brewer underwent Mirena IUD insertion in October of 2007. She went in for a follow-up appointment six weeks later. At this point, the device appeared to be working normally, and Brewer had no complaints. However, in March of 2008, she began to experience pain and cramping. Brewer’s physician had to remove the device, and Brewer has “continued and required additional medical care, treatment and testing” since the Mirena removal procedure.

The lawsuit argues that Bayer was negligent in that they knew – or reasonably should have known, based on postmarket surveillance and clinical trials – about the serious risks of complications associated with the Mirena IUD. The lawsuit further alleges that despite this knowledge, they continued to manufacture, market and distribute the IUD while downplaying Mirena side effects. The complaint also asserts that Bayer was fraudulent in that they concealed the problems with the device from patients and their health care providers, preventing people from having all of the information they needed to make an informed medical decision.

The Mirena lawsuit is Ashley Brewer v. Bayer Healthcare Pharmaceuticals Inc., Case No. 3:13-cv-00755-DRH-PMF, United States District Court, the Southern District of Illinois.
