Mirena IUD Lawsuits Being Filed Nationwide

By Amanda Antell

Lawsuits over Mirena IUD injuries are pressing on as more women are coming forward to allege they suffered serious side effects from the popular birth control device.

As of July 10, 2013, there are 105 Mirena lawsuits now consolidated in federal court in the Southern District of New York, alleging that the Mirena IUD caused severe and debilitating complications in their users. The judge assigned to this Mirena lawsuit MDL is U.S. District Court Judge Cathy Seibel.

Among the allegations raised in these Mirena lawsuits is that the device migrated from the original position of insertion in the uterus to other parts of the body, sometimes all the way up to the ribcage. This caused pain, suffering and immediate surgical action to remove the migrated IUD. In some reports, the migration of the Mirena IUD caused kidney infection and infertility.

Plaintiffs and their Mirena injury lawyers are calling out pharmaceutical company Bayer on its Mirena side effect warnings, stating that they were inaccurate, embellished the benefits, and barely outlined the risks associated with the device. In 2010, there were no fewer than 25,000 adverse event reports citing various Mirena birth control side effects. That year also marked the 10-year anniversary of Mirena’s introduction to the market.

Other allegations from Mirena lawsuit plaintiffs include irregular menstrual bleeding, pain and suffering, limited mobility and inconvenience, and — in the most severe cases — unexpected or ectopic pregnancies.

Mirena IUD Problems Surge

The Mirena IUD received FDA approval in 2000 as a contraceptive, and was later approved to treat heavy menstrual bleeding in 2009. The Mirena IUD is a t-shaped birth control device that works by being placed in the uterus, and is designed to last up to five years to prevent pregnancy. The device releases progestin levonorgestrel into the uterus to prevent the release of eggs in a woman’s ovaries.

Ever since its release in 2000, FDA records show that there have been more than 50,000 injury reports from women and health care professionals citing side effects allegedly caused by the Mirena IUD. Despite these results, Bayer Pharmaceuticals continues to market the product as a safe and convenient choice compared to birth control pills and other contraceptives available. The marketing campaign became so aggressive that the FDA issued a letter of warning against the company for their conduct.

The letter was issued in 2010, stating that the company was inadequately explaining and describing the likelihood of the health risks associated with Mirena IUD while exaggerating the benefits. Additionally, the FDA also addressed the increased number of adverse reports that it was receiving regarding Mirena. The agency directed Bayer to change the Mirena warning label regarding its side effects and how often they occur. These warning have helped bolster Mirena injury lawsuits filed by hundreds of women across the U.S. Many of these lawsuits have been consolidated into multidistrict litigation to expedite the legal process.

The Mirena lawsuit MDL is In Re: Mirena IUD Products Liability Litigation, MDL 2434, U.S. District Court, Southern District of New York.
