Mirena IUD Caused Ectopic Pregnancy, New Lawsuit Claims

Another Mirena IUD lawsuit has been filed by a Minnesota woman after the birth control device allegedly caused her to have an ectopic pregnancy as well as other serious side effects. It has been reported by the United States Food and Drug Administration (FDA) that ectopic pregnancy is one of the most dangerous side effects of the Mirena IUD as it can be life-threatening if not detected in time and prompt treatment is not received.
The Mirena lawsuit was filed on January 4, 2013 in the Superior Court of New Jersey Law Division in Morris County and is now referred to as Case No. MRS L-0060-13. The plaintiff has named Bayer Healthcare Pharmaceuticals, Inc. as the defendant.
Mirena Lawsuit Details
The plaintiff states in the Mirena IUD lawsuit that she started using the birth control implant in April 2006. In the beginning there appeared to be no issues. However, in January 2009 her medical care provider could no longer locate the strings connected to the Mirena IUD. The physician then had a sonogram completed and discovered that the plaintiff’s uterus had been partially perforated on her right side. During this time it was also discovered that the plaintiff had an ectopic pregnancy. This was described as a “mass-like lesion” that was located next to the plaintiff’s right ovary.
From there the plaintiff had to undergo laparoscopic surgery in order to recover the Mirena IUD as well as remove the ectopic pregnancy. The Mirena lawsuit claims that these side effect injuries were caused directly by the Mirena IUD birth control implant. It also claims that she has now experience both severe as well as permanent injuries that have caused a great deal of pain and suffering because of the Mirena birth control device. Economic loss is also claimed as well.
There have been hundreds of Mirena lawsuits filed against Bayer, which has been the subject of scrutiny by the Department of Health and Human Services’ Division of Drug Marketing, Advertising, and Communications (DDMAC). Bayer received a warning in 2009 because the manufacturer was making claims about Mirena birth control that were unsubstantiated and they also failed to warn about the side effect risks.
Some of the other very serious side effects Mirena has been linked to include the following:
- Group A streptococcal sepsis
- Embedment of the device in the uterine wall
- Intrauterine pregnancy
- Perforation of the uterine wall
- Pelvic inflammatory disease (PID)
Mirena Lawsuit MDL
At this time there has not been a multidistrict litigation (MDL) established for the many Mirena IUD lawsuits that have been filed by side effect victims. However, there was a petition recently filed that requests the Mirena lawsuits to be consolidated in the United States District Court for the Northern District of Ohio, Eastern Division. If approved, the Honorable Patricia A. Gaughan would be presiding over the Mirena lawsuit MDL which would be referred to as In Re: Mirena IUD Product Liability Litigation, Case No. 1:12-CV-2780. There is a good chance that this request will be approved.
