A Pennsylvania resident recently filed a Benicar lawsuit against Daiichi Sankyo, Inc., alleging he suffered psychological damage caused by Benicar.
The plaintiff, Michael P., began taking Benicar at the direction of his doctor in March 2009. After beginning to take Benicar, however, the plaintiff started to suffer from mild to severe complications.
Physical side effects noted in the Benicar lawsuit include abdominal pain, nausea, diarrhea, weight loss, diet change, IBS, and diverticulitis. The psychological damage caused by Benicar noted in the lawsuit included severe mental pain and damage.
According to the Benicar lawsuit, these side effects will cause lasting problems for the plaintiff, including loss of enjoyment of life, physical and mental damage, and monetary expenses.
Michael P. filed the Benicar lawsuit in early November 2016.
He filed the lawsuit over physical and psychological damage caused by Benicar on multiple counts, including defective design, failure to warn, gross negligence, fraudulent concealment, constructive fraud, breach of express and implied warranties, and violation of consumer protection law of the state of Pennsylvania, among several others.
Benicar Background
Benicar (also known by its generic name, olmesartan medoxomil) is an extremely popular and widely used medication.
Benicar is manufactured and distributed by Daiichi Sankyo, Inc. Benicar was first approved by the U.S. Food and Drug Administration (FDA) in 2002 to treat hypertension.
Benicar is one of a variety of olmesartan drugs currently available on the drug market, alongside Benicar HCT, Azor, and Tribenzor.
Nearly 2 million people in the United States were filing olmesartan prescriptions each year by 2012, only 10 years since their initial approval.
Side Effects Could Include Psychological Damage Caused by Benicar
Despite the popularity of olmesartan drugs like Benicar, the drug has actually been linked to a variety of serious side effects.
The link between Benicar and serious side effects has been noted in a variety of studies, complaints, and lawsuits. For some, these complications are mild and go away on their own, without further treatment.
For others, however, these side effects can be quite severe, affecting their lives significantly and sometimes requiring medical treatment, like the plaintiff involved in this lawsuit.
The FDA issued a drug warning in 2013 over Benicar gastrointestinal side effects.
Benicar Lawsuits
Benicar lawsuits like this claim that Daiichi Sankyo either knew or should have known that Benicar causes major side effects in some users, some of which may be as dangerous as kidney failure.
However, the pharmaceutical company failed to adequately warn both the public and the medical community about the link between Benicar and these injuries, lawsuits claim.
Plaintiffs allege that, had Daiichi Sankyo given adequate warning of Benicar’s side effects, they would have chosen a safer alternative to Benicar.
Though filing a Benicar lawsuit cannot take away the pain and suffering experienced by some Benicar users because of these side effects, it can help to compensate for financial expenses that may have been incurred by these problems.
If you or someone you love has taken Benicar or a similar olmesartan drug and since suffered from mental or physical side effects, you may be able to file a Benicar lawsuit.
The Benicar Lawsuit is filed within the larger Benicar MDL No. 2606, in the U.S. District Court for the District of New Jersey, Camden Vicinage.
