Illinois Woman Seeks Damages for Lipitor Diabetes Side Effects

Illinois resident Rhonda Conner is suing Pfizer, alleging that the company’s cholesterol drug Lipitor caused her to develop type-2 diabetes. She is seeking general, compensatory and punitive damages, as well as compensation for any legal fees and medical bills, according to a complaint filed July 1, 2013 in U.S. District Court for the Southern District of Illinois.
Conner alleges in the Lipitor diabetes lawsuit that she began taking the medication in 2008, believing that it would help limit the risk of cardiovascular disease, and developed type-2 diabetes side effects roughly one year later. She alleges that Pfizer had data regarding these Lipitor side effects more than a decade earlier in 1996, and is suing for claims of failure to warn, negligence, breach of implied warranty, fraud and constructive fraud as well as unjust enrichment.
Failure-to-warn and breach-of-implied warranty claims revolve around similar factual allegations, specifically that a company should provide accurate drug safety information regarding potential side effects including Lipitor type-2 diabetes. Negligence implies that a company such as Pfizer did so out of carelessness or by willfully avoiding its legal duties.
Conner’s Lipitor lawsuit attorney will also likely argue that by selling a product with these potential side effects, Pfizer engaged knowingly in fraud and profited when it should have updated drug safety information that would have led Conner or her doctor to pursue other options, or at least monitor blood glucose levels to prevent type-2 diabetes side effects.
Instead, as a result of the Pfizer medication, Conner’s Lipitor diabetes lawsuit notes that she is at risk of cardiovascular disease from the side effects, as well as blindness and other issues due to her 2009 diagnosis.

I have the same problem as Rhonda Conner of Illinois. I too started taking Lipitor around 2008 and have since developed Diabetes II within the last year. I nor anyone in my family ever had any problem with diabetes.
