Georgia Woman Sues Bayer for Mirena IUD Injuries

Mirena IUD injury lawsuitGeorgia plaintiff Jessica Van Dusen is suing Bayer Pharmaceuticals for the injuries she allegedly sustained from the company’s Mirena IUD, a popular intrauterine contraceptive device. Van Dusen alleges in the Mirena lawsuit that she had to have the IUD surgically removed after it migrated out of her uterus, causing her serious injury and medical expenses.

Van Dusen claims in the Mirena lawsuit that the IUD insertion procedure had gone normally, giving no reason for her or her physician to suspect anything might go wrong. However, soon after the device was inserted a medical exam revealed that the IUD had perforated her uterus and migrated outside of the organ. According to the Mirena IUD lawsuit, at no point in time did Bayer warn the plaintiff or her physician about this possible Mirena side effect. Nowhere on Mirena’s warning label does it indicate IUD migration, perforation or the possible requirement of revision surgery, the lawsuit says. 

Van Dusen is suing Bayer for allegedly manufacturing, marketing, distributing and selling a dangerous product. The charges in her Mirena IUD lawsuit include negligence, misrepresenting a product and false advertising.

Overview of Mirena IUD Complications

The Mirena IUD, manufactured by Bayer, is an intrauterine device that is directly inserted into a woman’s uterus. It was approved by the U.S. Food & Drug Administration (FDA) in 2000. It is designed and used as a long-term contraceptive, meant to last up to five years. It is currently the only intrauterine device offered in the United States. With over 15 million women using the Mirena IUD today, it is one of the most popular birth control products in the world.

The Mirena IUD is also the only birth control pill to use levonorgestrel, a newly synthesized progestogen. At the end points of the t-shaped device, levonorgestrel is released directly into the uterus, preventing pregnancy. While considered very effective, there is not a lot of information available about levonorgestrel, leading many medical experts to believe that current data on the device is insufficient. In other words, it is currently unknown as to how the progestogen truly affects the body.

Additionally, there are currently no warnings or indications on the product’s label about the possibility of device migration, perforation and the ill effects of levonorgestrel. Bayer has been cited numerous times for aggressive and misleading advertising, with Mirena IUD being one of their most famous. The ‘Simple Style Program’ was a Mirena IUD advertisement geared towards mothers with at least one child. The advertisement promised women that the Mirena IUD would help them look and feel great and add intimacy to their sex lives.

This representation was a direct contradiction to scientific data, which reveals that the Mirena IUD decreases sex drive by 5 percent. Additionally, Bayer did not mention any of the other adverse side effects, such as weight gain, acne and breast tenderness, associated with the Mirena IUD.

Mirena IUD Lawsuits Grow

Hundreds of women have sued Bayer for alleged negligence in its marketing of the Mirena IUD. Van Dusen claims she is still at risk for suffering ectopic pregnancy, intrauterine pregnancy, cancer, adhesion, cysts, fetal injury, fetal death, early/premature menopause and other personal injuries from the contraceptive device. Van Dusen’s Mirena IUD lawsuit will be transferred into ongoing multidistrict litigation (MDL), joining hundreds of other women who allege similar injuries.

The Mirena IUD lawsuit is labeled as Jessica Van Dusen v. Bayer Pharmaceuticals, Case No. 7:13-cv-06588-CS, in the U.S. District Court for the Northern District of Georgia, Atlanta Division. The Mirena IUD MDL is In Re: Mirena IUD Products Liability Litigation, MDL No. 2434, in the U.S. District Court for the Southern District of New York.

    My IUD perforated my uterus and went into my abdomen. I just had laparoscopy surgery to get it removed and they couldn’t find it. I will likely be having another surgery. What can I do to help with this lawsuit?
