Generic Zoloft Manufacturers Immune From Lawsuits, Congress Fights To Make Them Culpable

The supreme court ruled in 2011 that generic drug manufacturers are not responsible for the warning labels placed on the boxes and pill bottles. What does this mean for parents of children who were born with birth defects which may be because of Zoloft or another antidepressant? It’s critical that congress passes the new bill which would protect Americans right to pursue generic drug manufacturers if they suffer injury from an unpublished side effect of their prescribed drug.
 
Zoloft and antidepressant birth defect lawsuits typically allege that Pfizer, and sometimes Zoloft distributor McKesson Corporation, should have warned pregnant mothers of the risk of taking Zoloft while pregnant. Zoloft birth defect lawsuits often include references to a study that Pfizer performed which showed that Zoloft could cause birth defects in but didn’t warn patients taking the drug of their findings. Pfizer conducted animal trials which found that Zoloft caused severe side effects in animal fetuses. Typical Zoloft birth defect lawsuit state that even though Pfizer knew of the risk of birth defects Pfizer did nothing to warn doctors and patients of the risks inherent in taking Zoloft while pregnant.
 
Antidepressant SSRI medications are alleged to cause serious and severe birth defects like congenital heart defects, low birth weight, still birth or babies were born with PPHN. Thousand of parents are expected to file lawsuits against Pfizer to help pay for medical treatment and pain and suffering which their children have endured to fix or treat Zoloft related birth defects.
 
Some parents who have had a baby born with an alleged Zoloft birth defect have opted to file a Zoloft birth defect class action lawsuit.
