Federal Mirena IUD Lawsuits Consolidated in New York

Mirena IUDFederal lawsuits over Bayer Healthcare’s Mirena intrauterine device (IUD) were consolidated Monday in U.S. District Court in the Southern District of New York. The cases accuse Bayer of negligently marketing Mirena by failing to disclose the risk of the device migrating after insertion and perforating the uterus, among other serious potential side effects.

The Mirena IUD is a T-shaped contraceptive implant that is implanted in a woman’s uterus and releases levonorgestrel, a synthetic hormone. Many women choose the Mirena IUD because it is a low-maintenance form of contraception. Unlike oral contraceptives, which require a woman to take the pill at the same time each day, the Mirena IUD can be left in the uterus for up to five years. Bayer has marketed the Mirena IUD as a form of contraceptive that helps busy moms simplify their lives, but failed to mention the serious side effects of Mirena, according lawsuit plaintiffs.

 

Federal Mirena IUD Lawsuits Consolidated in New York Court


Many women who allege the device migrated and perforated their uterus have filed Mirena IUD lawsuits. On April 8, 2013, these federal cases were consolidated in New York. For these cases, all pretrial proceedings will be handled by Judge Cathy Seibel because they involve substantially similar complaints against Bayer. Having one judge handle the pretrial proceedings will help to streamline the legal process.


The Judicial Panel on Multidistrict Litigation will order that federal cases be consolidated into multidistrict litigation (MDL) when there are a large number of cases filed with similar allegations. In the case of the Mirena injury lawsuits, numerous plaintiffs allege the device migrated and perforated their uterus. Unlike a class action lawsuit, plaintiffs involved in an MDL reserve the possibility that their individual case will go to trial. Damage awards in MDL cases are determined on a case-by-case basis.


Mirena IUD Side Effects


Despite its popularity, many women have suffered from serious side effects from the Mirena IUD. In some cases, the IUD can become embedded in the uterus after migrating from its original position. There have been reports that it can even migrate from the uterus and travel to other parts of the woman’s body, leading to a perforated uterus and damage other organs. When the Mirena IUD migrates within a woman’s body, she often must undergo surgery to remove the device.

  • Headaches
  • Spotting
  • Ovarian cysts
  • Vaginitis
  • Pelvic pain
  • Painful menstruation
  • Breast tenderness
  • Ectopic pregnancy
  • Intrauterine pregnancy
  • Pelvic inflammatory disease
  • Infertility
