FDA Recall Important Evidence in GranuFlo/NaturaLyte Lawsuits

By Andrea Gressman

GranuFlo, NaturaLyte side effectsBoth NaturaLyte and GranuFlo have been linked to a number of harmful side effects, leading a number of victims to sue the company responsible for manufacturing the dialysis concentrate products, Fresenius Medical Care. In the event that GranuFlo or NaturaLyte side effects claimed the life of the medication user, the family members of that individual have frequently filed a wrongful death lawsuit against Fresenius.

In many similar cases where a product has been known to cause severe and potentially fatal side effects it has been very difficult to prove that the product was responsible for the victim’s injuries. But in the situation of NaturaLyte and GranuFlo it is actually much easier because of the FDA recall that was issued in March of 2012.
It has been estimated that in the United States 400,000 patients receive dialysis treatment on an annual basis. It has also been estimated that a third of the patients receiving dialysis use Fresenius products, either GranuFlo or NaturaLyte. These products are used to neutralize acid build up in the patient when they are receiving dialysis. However, GranuFlo and NaturaLyte were not formulated as many other comparable dialysis products were created. As a result, when the doctors were mixing the Fresenius products at the same rate as other dialysis products in their class it was much too strong for the patient, which resulted in too much bicarbonate being formed in the person’s body. This ultimately led to a number of patients experiencing severe side effects, such as a heart attack.

Because of this overdosing of GranuFlo and NaturaLyte there were nearly 1,000 deaths by the time Fresenius issued an internal warning in November of 2011. However, this warning was not extending to others who used the Fresenius products outside the Fresenius clinics, nor did it include the public in general. This put thousands of patients at a continued risk of developing severe and potentially fatal side effects until the FDA came in and issued the class 1 recall several months later in March of 2012.

The FDA class 1 recall is a critical component for the many NaturaLyte and GranuFlo lawsuits that have been filed. This is very important evidence when it comes to the link between NaturaLyte and GranuFlo and the side effect injuries they are being charged with in the many NaturaLyte and GranuFlo lawsuits that have been filed against Fresenius. This will bring the many plaintiffs that much closer to receiving the compensation that they deserve.
