Father Files Yasmin/Ocella Lawsuit Over Daughter’s Death

Ocella birth controlA distraught father has filed a Yasmin and Ocella lawsuit against the makers of the popular birth control pills, claiming that his daughter suffered a pulmonary embolism, which resulted in her death. His 15-year-old daughter started taking Yasmin and then was later switched to Ocella, which is the generic version of Yasmin, to help treat her acne.

Yasmin/Ocella Lawsuit Details

Scott Prewitt, the father of Brittany Nicole Prewitt, is claiming in his Yasmin and Ocella lawsuit that Bayer aggressively marketed Yasmin and Yaz to dermatological groups for use against acne. Yasmin had not received approval for use against acne and therefore Bayer is responsible for the death of his daughter, Prewitt claims in the Yasmin death lawsuit.

Also claimed by the Yasmin/Ocella lawsuit is the advertising used for Yasmin downplayed the risks and inflated the benefits of Yasmin birth control. According to the Yasmin/Ocella lawsuit, “Bayer defendants have been warned multiple times by the FDA for misleading the public through use of television advertisements which overstate the efficiency of Yasmin and Yaz and minimize serious risks associated with the drug.”

Mr. Prewitt is suing Bayer, Teva Pharmaceuticals, Barr Laboratories and Intendis for the wrongful death of his daughter, which was caused by a pulmonary embolism from a Yasmin/Ocella blood clot. The Yasmin/Ocella wrongful death lawsuit is also accusing the pediatricians and Asheville Children’s Medical Center who treated Brittany for failure in identifying and diagnosing the Yasmin/Ocella blood clot that took her life in June of 2009.

Yasmin and Ocella Lawsuit News

As more and more women continue to rely on Yasmin, Yaz, Beyaz and Ocella for their birth control needs and experience severe blood clot side effects as a result, more and more Yasmin lawsuits, Yaz lawsuits, Beyaz lawsuits and Ocella lawsuits are being filed. In a recent report by Bloomberg, it was revealed that Bayer has paid out more than $402 million in Yasmin/Yaz lawsuit settlements to victims of Yasmin blood clot injuries such as pulmonary embolism and deep vein thrombosis.

Judge Herndon is currently overseeing the Yasmin/Yaz Lawsuit MDL and at Bayer’s request has contacted George Washington University law professor Stephen Saltzburg in order for him to mediate the Yasmin lawsuit settlement process. Judge Herndon has since put the trial schedule on hold allowing time for these Yaz lawsuit settlement agreements to be reached. Early this summer, Saltzburg commented on the Yaz settlement talks on July 5, 2012 to an Illinois newspaper saying, “There are always some holdouts, but I think we will settle the bulk of these cases next year.”

What Causes the Severe Yasmin and Ocella Side Effects?

Drospirenone, a fourth-generation progestin, is the primary ingredient in the birth control products Yasmin, Yaz, Beyaz and Ocella. Yaz birth control, which is also made by Bayer, has been approved by the FDA to help treat moderate acne. However, as mentioned above, Yasmin and Ocella have not been approved by the FDA for this type of treatment at this time.

The U.S. Food and Drug Administration is now monitoring the safety of drospirenone contraceptives after two reports were released by the British Medical Journal citing the increased risks of blood clots from this contraceptive in comparison with others.
