DePuy ASR Hip Implant Caused Metal Poisoning, Lawsuit Says
By Sarah Pierce
An Ohio man has filed a lawsuit against DePuy Orthopaedics alleging he suffered serious side effects from the company’s metal-on-metal ASR hip replacement system, including elevated levels of chromium and cobalt in his bloodstream. Metal poisoning (or metallosis) is one of the many side effects of metal-on-metal hip implants like the DePuy ASR, which was recalled in August 2010. Roughly 6,200 DePuy ASR lawsuits have been filed in federal courts throughout the country as patients begin to suffer complications from the defective devices.
The 55-year-old Ohio Plaintiff alleges in the DePuy ASR lawsuit that he received a DePuy ASR metal-on-metal hip implant in his right hip in October 2006 and received a second ASR hip replacement in his left hip the following month. The defective devices caused him to suffer serious complications and side effects, including high levels of cobalt and chromium, chronic pain, revision surgeries and knee surgery. He eventually had to remove the DePuy ASR hip implants nearly five years later. His DePuy ASR hip implant lawsuit is seeking damages for personal and economic injuries, including medical expenses, multiple doctor visits, constant pain and suffering, loss of income and overall loss of quality of life.
The DePuy ASR all-metal hip replacement system was recalled on August 24, 2010 after it was discovered that 1 out of every 8 patients (13%) who received the metal-on-metal hip implant had to undergo revision surgery to replace the defective device. The problem, hip implant lawyers say, is the metal-on-metal design of the DePuy ASR, which can cause the metal components to rub together and corrode, shedding metal ions like chromium and cobalt into the bloodstream. This can lead to a host of metal hip implant side effects, including blood poisoning (metallosis), local tissue damage, bone damage, pseudotumors, pain and swelling, dislocation, implant loosening, impaired mobility, and more.
Since the August 2010 DePuy ASR recall, thousands of patients implanted with the device have come forward to complain of complications. Many of these have – or will – undergo revision surgery to replace the defective device.
It’s not just the DePuy ASR that has come under fire, however; nearly every metal-on-metal hip implant on the market has been associated with the same serious complications, including revision surgery. In July 2012, the U.S. Food and Drug Administration (FDA) revealed it received nearly 17,000 adverse event reports associated with metal-on-metal hip implants from 2000 to 2011. An FDA advisory panel recently recommended that patients with metal-on-metal hip implants should be regularly monitored to ensure the devices are not failing or shedding dangerous levels of metal ions.
If you received a DePuy ASR or other metal-on-metal hip implant manufactured by DePuy, Johnson & Johnson, Wright Medical Technology, Biomet or another company, you may have legal options to pursue compensation for your pain, suffering and medical expenses. A metal hip implant compensation specialist can provide a free consultation about your rights, and determine if you have a case.
