CVS Pharmacy markets and sells lidocaine patches which prematurely peel off after only a few hours of use, a new class action lawsuit alleges.ย
Plaintiff Monique Bell claims the patchโs inability to stay on the skin keeps consumers from getting up to 12 hours of a โMaximum Strengthโ lidocaine dose, as the packaging promises.ย
Bell wants to represent a nationwide Class and New York subclass of consumers who have purchased CVS Lidocaine Patches.ย
Bell says she chose to pay more for the CVS Lidocaine Patches on multiple occasions, believing representations that they would stay on her body for up to 12 hours.ย
The lidocaine patches repeatedly failed to provide the amount of pain relief that the packaging promised, however, since they would peel off well-before 12 hours, says Bell.
โPlaintiff became frustrated when her Lidocaine Patches peeled off her body while engaging in regular activitiesโsuch as walking, sitting, stretching, and sleepingโwell before the represented 12 hours, through no fault of her own,โ the class action lawsuit states.ย
Bell claims CVS is aware its lidocaine patches do not properly stick to consumers, pointing to โdozens of complaintsโ left on the companyโs website.ย
The FDA has also done reports and scientific studies on the efficacy of lidocaine patches, finding the transdermal mechanism of delivery โ which CVSโ lidocaine patches use โ is not effective, according to the class action lawsuit.ย
โAccording to FDA reports, transdermal drug delivery systems, such as the one used by Defendant, systematically fail to adhere to the body,โ the class action lawsuit states.ย
Bell claims CVS is in violation of New York General Business Law, New Yorkโs Warranty Act, and the Magnuson-Moss Warranty Act.ย
Plaintiff is demanding a jury trial and requesting injunctive relief along with compensatory and punitive damages for herself and all Class Members.ย
Earlier this month, a federal judge in Illinois declined to dismiss a class action lawsuit filed against CVS that alleges the company repeatedly placed illegal robocalls to consumers across the country.ย

They definitely do not stay on
My daughter and I used them for about 3 weeks. They just didnโt stay put, nor did they offer any relief.
Simply put, they donโt stick long enough to help with my pain. I kept putting my hand on the patch to try to get it to stick all the time. I have pain in various places and I tried them all with no success.

I have been using this pad for approximately 3 years.i purchase it regularly. They roll up and stick to everything but hour body.
I got a box thru my Medicare advantage otc account. I couldnโt use them because as soon as I started walking it would fall off. Very disappointed that I wasted my money on them.
Itโs very true. The patches peel off and stick to your shirt or T-shirt at the slightest movement interference even before an hour.
Didnโt stay on very long
They never stayed on.
