CVS Lidocaine Patches Class Action Lawsuit Overview:ย

CVS Pharmacy markets and sells lidocaine patches which prematurely peel off after only a few hours of use, a new class action lawsuit alleges.ย 

Plaintiff Monique Bell claims the patchโ€™s inability to stay on the skin keeps consumers from getting up to 12 hours of a โ€œMaximum Strengthโ€ lidocaine dose, as the packaging promises.ย 

Bell wants to represent a nationwide Class and New York subclass of consumers who have purchased CVS Lidocaine Patches.ย 

Bell says she chose to pay more for the CVS Lidocaine Patches on multiple occasions, believing representations that they would stay on her body for up to 12 hours.ย 

The lidocaine patches repeatedly failed to provide the amount of pain relief that the packaging promised, however, since they would peel off well-before 12 hours, says Bell.

โ€œPlaintiff became frustrated when her Lidocaine Patches peeled off her body while engaging in regular activitiesโ€”such as walking, sitting, stretching, and sleepingโ€”well before the represented 12 hours, through no fault of her own,โ€ the class action lawsuit states.ย 

Bell claims CVS is aware its lidocaine patches do not properly stick to consumers, pointing to โ€œdozens of complaintsโ€ left on the companyโ€™s website.ย 

The FDA has also done reports and scientific studies on the efficacy of lidocaine patches, finding the transdermal mechanism of delivery โ€” which CVSโ€™ lidocaine patches use โ€” is not effective, according to the class action lawsuit.ย 

โ€œAccording to FDA reports, transdermal drug delivery systems, such as the one used by Defendant, systematically fail to adhere to the body,โ€ the class action lawsuit states.ย 

Bell claims CVS is in violation of New York General Business Law, New Yorkโ€™s Warranty Act, and the Magnuson-Moss Warranty Act.ย 

Plaintiff is demanding a jury trial and requesting injunctive relief along with compensatory and punitive damages for herself and all Class Members.ย 

Earlier this month, a federal judge in Illinois declined to dismiss a class action lawsuit filed against CVS that alleges the company repeatedly placed illegal robocalls to consumers across the country.ย

    I have used these as well. I had to tape them to my skin. Salonpas work much better

    I have very bad tension headaches that start in my neck and go to the tip of my nose. I have tried several things and the lidocaine patch from cvs was something that I boughtโ€ฆ actually bought an entire case of them. I too would put them on โ€ฆ try to go about my day and fund the either completely off laying on the floor or rolled off my skin not attached to my neck anymore

    They just donโ€™t stick Its a real rip off .my prescription pads work a little better. but they are $20.00.

    I tried these over the REAL lidocaine patches and they are useless! They did not stick long enough to be effective! Please add me!

    these are the worse!!! I have repeatedly thrown them away they do not stickโ€ฆsometimes they wonโ€™t even let me get them on my skin!!! Please add meโ€ฆ.

    Those Lidocaine patches donโ€™t stay on. They just roll off your skin. They donโ€™t work on me because they donโ€™t stay on long enough. Have arthritis, fibromyalgia, sciatica and other back problems. It would be nice if the patches stayed long enough to ease my pain.
