Couple Files Asbestos Lawsuit After Husband Develops Mesothelioma
By Andrea Gressman
On September 14, 2012 another asbestos exposure lawsuit was filed in Kanawaha County Circuit Court. The lawsuit was filed by both Roscoe H. Peters and Mary J. Peters, a couple from the South Beaver, West Virginia, area. The asbestos lawsuit requests to have a jury trial examine their claims that Mr. Peter’s mesothelioma cancer diagnosis is a direct result of his on-the-job exposure to asbestos.
In this mesothelioma lawsuit it states that the companies should be held accountable for Mr. Peter’s asbestos exposure because they were his employers. Roscoe worked from 1950 to 1983 with Weirton Steel as a laborer and an electrician before he became ill in 1983 due to asbestos exposure.
Eighty-six companies, which include two from local headquarters, are being sued in the asbestos mesothelioma lawsuit by the South Beaver Township couple. The Peters are seeking to hold them accountable for the husband’s exposure to toxic levels of asbestos, which is said to have caused Mr. Peters to develop mesothelioma, an aggressive cancer.
Roscoe Peters, who is 80 years old, received a diagnosis of mesothelioma, a lung-attacking rare cancer due to his toxic level of exposure to asbestos with Weirton steel, the couple claims in their mesothelioma lawsuit. Asbestos was at one time used in a widespread fashion as an insulator.
As noted in the asbestos lawsuit, from 1951 to 1964, Roscoe Peters did smoke a daily pack of cigarettes, but stopped after 1964.
The accusation of negligence on the part of the companies is alleged on the asbestos mesothelioma lawsuit. They failed to provide Peters any kind of protection against buildings that were contaminated, plus they failed to provide adequate warnings and notices of the dangers of asbestos exposure.
Current Asbestos Exposure and Mesothelioma Class Action Lawsuit and Settlement Investigation
Being exposed to asbestos is one of the leading causes to developing mesothelioma and other related diseases like asbestosis. Thousands of people have died from these highly aggressive cancers despite the fact that many have never even heard of mesothelioma or asbestosis. Hundreds of asbestos victims have file mesothelioma lawsuits, joined mesothelioma class action lawsuits, and subsequently received a settlement for the pain and suffering they have had to endure due to the mesothelioma and its treatment.
Prior to 1990, asbestos usage was prevalent because of its inexpensive cost and durability. And what many people don’t realize is that there are still products right here in the United States that still have small amounts of asbestos in them. Because of its popularity at one time and the fact that it is still being used, even on a small scale, people are still being exposed to asbestos and are still developing mesothelioma as a result.
Mesothelioma lawsuits and asbestos class action lawsuits are being litigated across the nation due to the mesothelioma victims and their families needed help with the expensive medical treatment, the loss of wages, as well as the extensive amount of pain and suffering that this deadly cancer causes. Sadly, family members are also developing mesothelioma and asbestosis due to the exposure they have received through the asbestos exposed worker.
