A Colorado woman is suing Bayer Pharmaceuticals for the injuries she sustained after taking their popular birth control pill, Beyaz. The plaintiff alleges that she suffered from bilateral pulmonary embolism by using Beyaz.
According to court documents, the plaintiff was first prescribed Beyaz in October 2011, in which she suffered from a bilateral pulmonary embolism on October 14, 2011. The plaintiff states that neither she nor her physicians were aware of the risks the drug imposed, and that she would have opted not to take the medication had she been informed.
Additionally, the Beyaz lawsuit claimed that there were no warnings or indications from the drug’s label to warn of possible side effects. Bayer made no effort to contact her to notify her of this, an action that the plaintiff says the company was obligated to do. Because Bayer manufactures and sells this drug to the public, the plaintiff contends that it is the responsibility of the drug company to warn patients of the possible adverse effects that their product could cause.
The plaintiff is suing Bayer Pharmaceuticals for being directly responsible for selling, marketing, distributing, and marketing an allegedly dangerous drug. She is also suing Bayer for false advertising, misrepresenting a product and concealing information.
Overview of Beyaz Complications
Beyaz is the combination of Bayer’s popular oral contraceptive, Yaz, with a B vitamin component, earning its name from the combination. Yaz and its older brother, Yasmin, were approved by the FDA in 2006 and 2001 respectively, and Beyaz now follows the FDA’s line of approval, earning it in December 2010. This makes Beyaz the newest birth control pill from Bayer, and adds another birth control pill which contains drospirenone to the United States market. Like its older siblings, Beyaz is prescribed for contraceptive purposes for female patients.
Drospirenone is a synthetic progestin, and is the main ingredient in Yaz, Yasmin, and Beyaz. Dropsirenone is a ‘fourth-generation’ progestin, meaning it is very new to the scientific community, with only few drugs containing it. Each of the drug in the United States market which have this in their makeup, belong to Bayer Pharmaceuticals. While the pharmaceutical giant normally boasts about this fact, the recent litigation fire has caused the company to retract some of its earlier statements about drospirenone, earning the company mass criticism from the public and medical community.
According to the medical experts, because drospirenone is still new to market, there is insufficient evidence which supports drospirenone of being completely safe, or being superior to other birth control pills. Despite this, the FDA has cited Bayer several times before for stating that dropsirenone is a superior progestin, making their products superior in the oral contraceptive market. Most of these Yaz and Yasmin advertisement contained untrue or exaggerated facts without scientific evidence, with failing to mention the possible side effects of the drugs.
In October 2008, Bayer was forced by the FDA to go on a corrective advertising campaign which cost the company $20 million, redoing almost all of their Yaz and Yasmin commercials. The company had to submit its advertising materials to the FDA for screening for the next six years.
Yaz Litigation Movement
Despite the FDA’s penalties and the overwhelming scientific evidence, Bayer still continues to aggressively advertise Yaz, Yasmin, and Beyaz.
