After suffering from chemotherapy permanent hair loss, a breast cancer patient has filed a lawsuit against Sanofi-Aventis, alleging the company failed to warn of this risk.

According to the chemotherapy permanent hair loss lawsuit, the plaintiff, Francis D., was treated with Taxotere as part of her chemotherapy regimen from January 2013 through May 2013.

Hair loss is one of the most well-known side effects of chemotherapy for cancer patients. However, even after her chemotherapy treatment was over, Francis’ hair loss persisted — a risk she and many others in her position allege they were not warned about.

According to the complaint, Francis would not have used Taxotere had she known of the risk of chemotherapy permanent hair loss.

The Louisiana plaintiff filed her March 31 complaint in the U.S. District Court for the Eastern District of Louisiana. The chemotherapy permanent hair loss lawsuit was filed on multiple counts, including failure to warn, negligence, negligent and fraudulent misrepresentation, fraud and deceit, breach of express warranty, and several others.

Taxotere Basics

Taxotere (also known by its generic name, docetaxel) is manufactured and sold by Sanofi-Aventis. Taxotere is one of the most popular breast cancer treatment drugs, and was approved by the U.S. Food and Drug Administration (FDA) back in 1996. Since its introduction to the market, Taxotere has only grown more popular.

In order to fight cancer, Taxotere works to prevent cancer cells from growing and spreading. However, the same function that prevents the rapid growth of cancer cells may also prevent the re-growth a patient’s hair after chemotherapy is over.

While cancer patients generally expect that they may lose their hair while undergoing chemotherapy cancer treatment, they also expect that their hair will grow back. However, many cancer patients have discovered after cancer treatment with particular drugs, including Taxotere, their hair will either not grow back or grows back with great difficulty.

Chemotherapy Permanent Hair Loss Lawsuits

The Taxotere lawsuit alleges that the company not only failed to adequately warn about this risk, but even actively concealed this risk. Plaintiffs claim that Sanofi has been aware of reports and studies linking Taxotere to permanent hair loss after chemotherapy since as far back as its approval in 1996.
