Birth Injury Medical Malpractice Lawsuit Transferred to California Federal Court

Birth Injury LawsuitFacundo Palacio Diaz and Micaela Palacio have filed a birth injury medical malpractice lawsuit, alleging that Banner Health doctors failed to properly care for their daughter Isabella during her delivery.

The birth injury lawsuit, recently transferred to U.S. District Court in California, alleges that Isabella developed birth defects because of inadequate care during her birth in April 2012. While it does not name which doctors or nurses were involved, the birth injury lawsuit alleges that the medical professionals were negligent and the healthcare system was also negligent for hiring them. Counts against officials and the hospital system include negligence, negligent infliction of emotional distress and loss of consortium.

Other cases involving birth injuries often include conditions that include heart defects or cerebral palsy. While not known in the case of Isabella Palacio, many developmental problems or delays can be linked to interruptions in oxygen flow during delivery, possibly leading to persistent pulmonary hypertension of the newborn (PPHN).

During litigation involving birth injuries, expert witnesses often testify that inadequate medical care included nurses and doctors did not properly monitor the pulse rate of an infant. Each fetus is different, but disparities in heartbeat counts are often a sign of a child in distress prior to delivery. Other concerns regarding birth defects include breach births and shoulder dystocia. These conditions can lead to lasting damage, either because of heart defects, cerebral palsy or portions of the fetal brain dying off due to a lack of oxygen. All can require surgeries or necessitate physical therapy. In many cases, the quality of life for a child is permanently altered due to disability.
