Stomach and intestine male anatomy anterior x-ray viewA Tennessee plaintiff recently filed a lawsuit against Daiichi Sankyo, alleging the company’s drug led to Benicar villous atrophy side effects.

The plaintiff, Walter O., began taking Benicar at the direction of his doctor in 2012, the lawsuit claims.

According to the lawsuit, the plaintiff suffered a number of side effects as a direct result of taking Benicar, including nausea, vomiting, diarrhea, abdominal pain, fatigue, dehydration, sprue-like enteropathy, and Benicar villous atrophy.

The Benicar villous atrophy lawsuit cited multiple damages, including injury to the plaintiff, economic loss, and loss of consortium.

It was filed on multiple counts, including defective design, failure to warn, negligence, fraudulent concealment, fraud, breach of express and implied warranties, and others.

By filing this Benicar villous atrophy lawsuit, Walter O. hopes to receive compensation for the physical and financial harm he has suffered as a direct result of taking Benicar, the lawsuit claims.

Benicar Basics

Benicar (also known by its generic name, olmesartan medoxomil) is a popular hypertension drug manufactured and distributed by Daiichi Sankyo, Inc. Benicar was approved to treat hypertension by the U.S. Food and Drug Administration (FDA) in 2002.

Benicar is just one of a number of olmesartan drugs that have been brought into the drug market in recent years. Other olmesartan drugs are marketed as Benicar HCT, Tribenzor, and Azor.

After their release onto the market, these olmesartan drugs skyrocketed in popularity. By 2012, nearly 2 million people were filling prescriptions each year.

Despite the popularity of olmesartan drugs like Benicar, Benicar has actually been linked with serious side effects in adverse event reports.

The FDA has responded to these adverse event reports, warning on July 3, 2013, about the risk of problems like chronic diarrhea and weight gain associated with Benicar. The FDA also approved a warning label change that would take these side effects into account.

Benicar Lawsuits

Benicar lawsuits like Walter O.’s allege that Daiichi Sankyo, Inc. either knew or should have known about the serious side effects, including Benicar villous atrophy, linked with their drug.

However, lawsuits claim, the company failed to adequately warn the public and the medical community about these risks.

According to a number of lawsuits, Daiichi Sankyo may even have actively misled their customers about the safety and efficacy of Benicar and other olmesartan drugs, choosing to market the drug as if they were not aware of the drug’s risks.

Plaintiffs claim that, had they been given adequate warning about the possibility of these side effects, they would have chosen a safer alternative.
