A Mississippi woman recently filed a lawsuit against Daiichi Sankyo, alleging she suffered from serious Benicar adverse side effects.
According to the lawsuit, the plaintiff, Yolanda E., began taking Benicar at the direction of her doctor in 2011.
As a direct result of taking Benicar, the lawsuit alleges, Yolanda began experiencing severe Benicar adverse side effects, including abdominal pain, nausea, vomiting, diarrhea, chronic sinusitis, and even gallbladder removal.
Not only did the Benicar adverse side effects cause physical pain and difficulties, but also led to substantial financial losses.
Yolanda’s lawsuit over Benicar adverse side effects was filed on fifteen counts, including defective design, failure to warn, gross negligence, negligent misrepresentation, fraudulent concealment, fraud, breach of express and implied warranties, and violation of state consumer protection laws of Mississippi, among several others.
Benicar Background
Benicar (also known by its generic name, olmesartan medoxomil) is an extremely popular and widely used hypertension medication .
Benicar is manufactured and distributed by Daiichi Sankyo, Inc. Benicar was first approved by the U.S. Food and Drug Administration (FDA) in 2002.
Nearly 2 million people in the United States were filling olmesartan prescriptions each year by 2012, only 10 years since their initial approval.
Benicar is one of a variety of olmesartan drugs currently available on the drug market, alongside Benicar HCT, Azor, and Tribenzor.
Benicar Adverse Side Effects
Despite the popularity of olmesartan drugs like Benicar, the drug has actually been linked to a variety of serious side effects.
The link between Benicar and serious Benicar adverse side effects has been noted in a variety of studies, complaints, and lawsuits.
For some, these complications are mild and go away on their own, without further treatment. For others, however, these side effects can be quite severe, affecting their lives significantly and sometimes requiring medical treatment, like the plaintiff involved in this lawsuit.
The FDA issued a drug warning in 2013 over Benicar gastrointestinal side effects.
Benicar Lawsuits
Benicar lawsuits like this claim that Daiichi Sankyo either knew or should have known that their drug causes major Benicar adverse side effects in some users, some of which may be as dangerous as kidney failure.
However, the pharmaceutical company failed to adequately warn both the public and the medical community about the link between Benicar and these injuries, lawsuits claim.
Plaintiffs allege that, had Daiichi Sankyo given adequate warning of Benicar’s side effects, they would have chosen a safer alternative to Benicar.
Though filing a Benicar lawsuit cannot take away the pain and suffering experienced by some Benicar users because of these Benicar adverse side effects, it can help to compensate for financial expenses that may have been incurred by these problems.
If you or someone you love has taken Benicar or a similar olmesartan drug and since suffered from mental or physical Benciar adverse side effects, you may be able to file a Benicar lawsuit.
The Benicar Adverse Side Effects Lawsuit is filed within MDL No. 2606, in the U.S. District Court for District of New Jersey, Camden Vicinage.
