Bayer Hit with Mirena IUD Migration Lawsuit

An Arkansas woman claiming her Mirena IUD became loose and was found floating freely in her pelvis filed a Mirena product liability lawsuit in the U.S. District Court for the Eastern District of Arkansas on January 4, 2013. She goes on to claim that this caused a number of severe side effects, including serious illness and injury.
The plaintiff, 29- year-old Susan Harp, claims in the Mirena lawsuit that Bayer Healthcare failed to properly warn women as well as the medical community about the potential side effect risks the Mirena IUD posed for women who chose to use this form of birth control. Some of these very serious side effects include the implant device migrating to another part of the body, failing to protect against pregnancy, and puncturing an organ.
The Mirena IUD has grown in popularity at a very rapid rate and as a result more and more women are experiencing the severe side effects linked to the birth control option. The Mirena IUD is a “T” shaped device that is implanted by a medical professional into the uterus. It has been approved to stay in place for up to five years. It is also supposed to be easily removed whenever the woman is ready to have it removed. One of the reasons that the Mirena IUD implant device is so popular is because women are supposed to have the convenience of not worrying about their birth control as long as the birth control device is in place. However, with the number of women experiencing such negative side effects, this has not been the case.
According to the plaintiff’s claims in the Mirena IUD lawsuit, Bayer either did know or should have known that the birth control device posed dangerous side effects to the women who used it. However, they continued to market and advertise Mirena IUD heavily and did not mention these serious side effect risks.
The Mirena lawsuit goes on to claim that the plaintiff had the Mirena IUD implanted in January of 2006. The Mirena lawsuit states that there were no initial complications. However, after the Mirena IUD had been in place for four years she was forced to seek medical care because she was experiencing extreme abdominal pain as well as vomiting. Ms. Harp then underwent a CT scan which revealed that the Mirena IUD had migrated and was no longer in place. The birth control device was floating freely in her pelvis and she had to have laparoscopy in order to have the Mirena IUD device removed.
While the plaintiff was recovering from the surgical procedure the plaintiff goes on to claim that she suffered from acute pyelonephritis. This is described as a urinary tract infection that goes on to reach the kidneys. It is very serious as it can cause kidney failure and even death.
The Mirena lawsuit charges Bayer with failure to warn and deceptive advertising. Bayer is also charged with defective design and manufacturing, strict liability, negligence, fraud, and breach of warranty. The plaintiff is seeking both punitive and compensatory damages.
