Arizona Woman Sues Bayer Over Mirena IUD Uterus Perforation

A lawsuit was filed last week against the pharmaceutical company Bayer by an Arizona woman who claims she sustained injuries as a result of the Mirena IUD (intrauterine device).
Plaintiff Cynthia Solano claims that the Mirena IUD that was inserted into her body in January 2011 perforated her uterus and ended up becoming embedded in her body. Solano filed her lawsuit in the U.S. District Court in Philadelphia on March 25, 2013.
IUDs are small, T-shaped devices that are inserted into the uterus as a form of birth control. One of the advantages of the IUD is that it can prevent pregnancy for several years. The Mirena IUD is effective for five years.
According to the Mirena lawsuit, after Solano was implanted with the device she began to suffer from cramping, pain, and spotting resulting in several doctor visits where she was continually told that the device was inserted properly.
In December 2012, Solano went to the hospital due to vomiting where she was diagnosed with renal failure and a slow heartbeat. A CT scan showed that the Mirena IUD was the culprit in the complications she was experiencing. As a result of these complications, Solano ended up having to have the Mirena IUD surgically removed.
Since the surgery, Solano claims she continues to suffer from side effects like persistent neck pain, continued abdominal pain, heavy menstrual bleeding, and severe cramping as well as limited mobility.
The lawsuit states that “the long-term consequences of these injuries on Ms. Solano’s health are unknown at this time, which is a source of great anxiety for her.”
Solano also lost income when she took time off from work, and used money from her 401K to pay her bills while recovering from her injuries.
“Additionally, Ms. Solano has significant out-of-pocket expenses for medical coverage and other costs associated with her Mirena-related problems,” the Mirena injury lawsuit states.
Solano is asking for compensatory damages, disgorgement of profits, statutory damages, attorneys’ fees, and litigation costs.
Solano is charging Bayer with improper design, developing, manufacturing, testing, marketing, promoting, distributing, advertising, and selling Mirena, which is “dangerous and defective in certain patients.”
She is also charging Bayer with failure to warn and instruct, negligence, fraudulent misrepresentation, fraud by concealment, and design defect, to name a few.
The Mirena lawsuit argues that the Mirena IUD is capable of perforating the uterus and traveling into other parts of the body — requiring surgical intervention, as was the case for Solano.
There are more than 40 Mirena IUD lawsuits currently filed against Bayer, but that number is expected to grow as the U.S. Food & Drug Administration (FDA) has received more than 40,000 complaints of Mirena side effects.
There is currently a petition before the U.S. Judicial Panel on Multidistrict Litigation to consolidate all Mirena lawsuits into one single district court.
