Type-2 Diabetes Drug Complications Lead to Actos Lawsuit
By John Curran
Richard Blouin alleges that consistent usage of a Takeda Pharmaceuticals type-2 diabetes medication led to cancer, according to a recently filed Actos side effects lawsuit.
The Rhode Island man began taking the medication in 2002, three years after Takeda received approval from the U.S. Food & Drug Administration (FDA). However, his Actos bladder cancer lawsuit attorney said that even before approval, mammalian studies indicated the possibility of tumors if the drug was taken consistently. Since it treats the chronic condition type-2 diabetes, most patients take it for more than one year.
One year is the cut-off time that the FDA and medical researchers have noted in studies and safety communications since 2005 where men and women like Blouin have a statistically significant increase in the chances of developing Actos bladder cancer side effects.
However, Takeda Pharmaceuticals officials in 2010 said that a 10-year longitudinal study did not merit a change in labeling in spite of the fact that it buttressed the evidence found in the PROactive study that had reviewed data beginning in 2005. However, European equivalents of the FDA called for other medications to be used in 2011. The company issued a recall in France that year regarding Actos side effects.
According to the Actos lawsuit, Takeda has “yet to adequately inform” patients and doctors “about the risks of bladder cancer with use of Actos for more than 12 months,” dating back to the pre-approval studies. As a result, Blouin is seeking damages on counts of negligence, defective design and manufacture, failure to warn, breaches of express and implied warranties, fraudulent misrepresentation and concealment.
The Actos side effects lawsuit is Richard Blouin v. Takeda Pharmaceuticals America Inc., et al., Case No. 13-cv-02695, in the U.S. District Court for the Western District of Louisiana.
