Married Couple Seeks Damages for Bladder Sling Failure

The Tennessee woman alleges that the transvaginal mesh implant failure resulted from a number of design defects. The use of polypropylene in the vaginal mesh was designed to lengthen the usable life of the device, but causes immune system reactions in many women who were implanted with these devices. Placement of the vaginal mesh implant has also led to increased infections in Mayo and many other women, according to the vaginal mesh lawsuit. Finally, the strength of the mesh wears down already weakened vaginal wall tissue.
The couple’s vaginal mesh lawyer includes counts of negligence, defective design, failure to warn, breach of warranties and loss of consortium in the lawsuit. The plaintiffs allege that adverse event reports to the FDA should have led to changes in marketing or product safety warnings, and that their marriage has been damaged as a result of Sandra’s bladder sling problems.
Less than four months after Mayo received the vaginal mesh implant, the FDA noted that the synthetic devices were a source of “continuing serious concern” because of a relatively high rate of side effects and damage resulting from a transvaginal mesh implant failure. Worse, the agency was unable to find any published or unpublished data indicating that the bladder sling products provided significantly improved outcomes for women looking to treat stress incontinence and related medical conditions versus existing alternatives.
