Judge Says Zoloft Birth Defect Lawsuits Can Move Forward

Zoloft birth defect lawsuitAs hundreds of SSRI birth defect lawsuits stand by awaiting trial, many of them targeting Zoloft, a federal judge has declared there are now enough Zoloft lawsuits for a move forward. This is good news for birth defect victims and their families, since it looks like the process will be moving quickly and standards will be put in place.

Many parents are suing SSRI manufacturers, claiming they failed to appropriately warn mothers-to-be about the birth defect risks associated with SSRIs like Zoloft. These types of medications are antidepressants, and doctors unknowingly prescribed them to patients who were pregnant, assuming the risks were minute. SSRIs have also recently been linked to autism.

SSRI Birth Defects Happen Early

According to recent research, most Zoloft-related birth defects take place very early in the pregnancy. This means that women who aren’t planning to get pregnant may be taking the drug and not realize they’re pregnant until it’s too late and the Zoloft birth defects are irreversible. Many physical and developmental birth defects are linked to SSRIs, and some of them cause a lifetime of health care, surgeries, and/or rehabilitation.

As of April 2013, over 300 SSRI birth defect lawsuits have joined forces and the federal judge overseeing them has stated that those numbers deserve to set a precedent. Combining these cases into multidistrict litigation (MDL) is often preferable for the plaintiffs because the settlements happen faster, there’s no risk of unfair compensation for some SSRI victims, and the discovery portion of the SSRI lawsuits are streamlined.

Diabetes Joins SSRI Side Effects

In addition to the countless types of birth defects connected to SSRIs, the FDA also added diabetes to the possible side effects of Zoloft and drugs like it. However, this addition to the safety labeling of SSRIs may or may not be heeded. At the moment, the only warning of birth defects on Zoloft packaging is that patients should let their doctors know if they’re pregnant or plan to become pregnant. According to Zoloft victims, that’s pretty vague wording for a very serious birth defect possibility.

Sadly, there’s always more than one SSRI victim when birth defects are present. Entire families struggle when a child is born with birth defects — and most of all, the child. Some birth defects require ongoing, regular care for an entire person’s life and, assuming they outlive their parents, it’s a huge financial burden.
