Pradaxa Wrongful Death Lawsuit Filed by Widow
By Andrea Gressman
The Pradaxa wrongful death lawsuit names Boehringer Ingelheim as the defendant. Mrs. Lutz is seeking over $75,000 in compensation for the loss of her husband based on the following claims:
- Breach of warranties
- Design defect
- Failure to warn
- Fraudulent concealment
- Negligence
- Negligent misrepresentation and/or fraud
- Survival action
- Wrongful death
Pradaxa (dabigatran) received its approval from the U.S. Food and Drug Administration (FDA) in October 2010. It was marketed as a treatment option for those who experience non-valvular atrial fibrillation. It works as a blood thinner and lowers the risk of a patient experiencing a stroke.
In the initial clinical trials it was revealed that Pradaxa was a better option than other comparable drugs, such as warfarin, when it came to preventing a stroke. However, there was a major issue when it came to the internal bleeding that Pradaxa has been linked to as a side effect. Unlink warfarin, Pradaxa was released onto the market without an antidote to stop internal bleeding should it occur.
The lack of an antidote for internal bleeding is exactly what this latest Pradaxa wrongful death lawsuit claims to be the issue. Mrs. Lutz claims that her husband started taking the drug in January 2011. After taking Pradaxa for just a short time he experienced an acute intracerebral hemorrhage with subarachnoid extension on February 8, 2011. After being hospitalized for 16 days, Mr. Lutz could not return home and was then moved to a hospice facility. He subsequently passed away on March 21, 2011. The Pradaxa lawsuit alleges that the side effects Mr. Lutz experienced were the direct result of his Pradaxa use.
The brain hemorrhage Mr. Lutz experienced is often referred to as a stroke, which occurs when a diseased blood vessel ruptures and blood leaks into the brain. Patients suffering a brain hemorrhage or stroke often go unconscious, which cause damage to the brain cells, or even death.
A subarachnoid extension is the collection of blood in a specific area of the brain. For Mr. Lutz this was the membrane that covered the brain. Some of the side effects this condition can include permanent brain damage, seizures, strokes, as well as other issues.
In addition to seeking damages for her husband’s death, Mrs. Lutz is requesting that the drug maker add a black box warning to Pradaxa.
