The Interesting Case of Ocella Side Effect Settlements

By John Curran

Yasmin, Yaz, Ocella birth controlBayer Pharmaceuticals sees no problem in settling thousands of Yaz and Yasmin side effect lawsuits for what will likely end up costing more than $1 billion. However, the fact that they are also paying off Ocella blood clot side effects victims raises an interesting point since Ocella is the generic version of Yasmin.

First off, it is good news for women who had blood clot problems and faced issues like stroke or pulmonary embolism. The blood thinners used to treat these conditions are dangerous in their own right. Getting help for long-term damage or even pain and suffering is a good outcome for Ocella blood clot side effects victims. However, it may be difficult to obtain without a skilled Ocella lawsuit attorney as there are legal hurdles to suing a generic drug manufacturer.

Bayer Pharmaceutical’s Yaz and Yasmin were both brand-name products used as oral contraceptives. In that regard, the company deciding to settle follows in line with the FDA issuing warnings regarding the increased likelihood of blood clots and other Yasmin side effects. However, and this may seem confusing, generic manufacturers do not have the same responsibility. If Company A made an equivalent that also had Yaz blood clot side effects, as long as the labeling matched up with the original drug’s label, they can’t be sued.

In the case of Ocella, Bayer actually is Company A. Theoretically the company could only be sued by Yaz lawsuit attorneys, and not those representing claims for those injured by the generic alternative. Yet they are still settling cases with those who have used Ocella, which may jive well with the rest of the strategy. After Yasmin settlement talks began in 2010 thanks to Judge David Herndon, Bayer decided to begin paying women who took the medications.

In that case, expending hundreds of thousands of dollars or more to fight the cases not filed by Yaz lawsuit attorneys makes little sense. In fact, the only remaining question is whether or not women who have dealt with gallbladder conditions will have to go to trial.

Still, settlements are possible for those suffering from Yaz blood clot side effects and other conditions from oral contraceptives produced by Bayer Pharmaceutical.
