First DePuy ASR Hip Implant Lawsuit Trial Underway

DePuy ASR hip implantThe first DePuy ASR hip implant lawsuit went to trial on Tuesday, January 22, in Los Angeles Superior Court. Lead plaintiffs Loren and Sheryl Kransky are suing Johnson & Johnson for manufacturing and selling the allegedly defective DePuy ASR, which the Kransky’s say caused Loren to develop cancer.

Since Loren is terminally ill, this particular trial was placed on an expedited fast track. This is the first metal-on-metal hip implant lawsuit to go to trial, which means it is being carefully watched by other plaintiffs and their attorneys as the outcome could have a significant impact on all of the other DePuy hip implant lawsuits pending against Johnson & Johnson.

FDA Investigation on Metal-on-Metal Hip Implant Side Effects

In May of 2011 it was reported that the United States Food and Drug Administration (FDA) launched its investigation into the side effects of metal-on-metal hip implants. In June of 2012, an independent advisory panel from the FDA found little to no benefit when it came to using the metal-on-metal hip replacement design in comparison to older hip implants that are made from ceramic or plastic components.

Just last week the FDA released a safety update giving the medical community new guidelines on the side effect risk of tissue damage that may be caused when someone uses a metal-on-metal hip implant.  There have already been many victims that have suffered significant injuries as a result of the side effects they experienced from their metal-on-metal hip implants. Many of these victims have gone on the file their own hip implant lawsuit against the manufacturer. Some of the metal-on-metal hip implants targeted in litigation include the following:
 

  • Biomet M2A-Magnum hip and Wright Conserve hip
  • DePuy Pinnacle hip
  • Metal on metal Smith and Nephew hips
  • Stryker Rejuvenate


Multiple MDLs Established for DePuy Lawsuits

There have been so many lawsuits filed against DePuy that they have been consolidated into multiple federal multidistrict litigations (MDLs).  It has been reported that there are over 3,000 DePuy Pinnacle lawsuits currently pending in an MDL held in the Northern District of Texas. The first trial in the DePuy Pinnacle MDL will begin by September 1, 2014.

There was also a DePuy ASR MDL created in the U.S. District Court for the Northern District of Ohio. Plaintiffs in this MDL expect their hip implant lawsuits to go to trial in May of 2013.

DePuy Hip Implant Side Effects

There are a number of severe side effects that have been linked to the DePuy Pinnacle and ASR hip replacement systems. Some of the side effects include the following:

  • Bone damage
  • Bone loss
  • Death of tissue around the joint
  • Loss of surrounding bone
  • Metallosis
  • Pain
  • Premature hip implant failure
  • Pseudotumors
  • Swelling
  • Tissue damage
