New Lawsuit Added as Paxil Settlements Move Forward

By John Curran

Paxil side effects settlementEven as companies set aside funding for settlements, it does not mean that new lawsuits do not receive merit. In the case of Paxil side effects, manufacturer GlaxoSmithKline has set aside $1 billion or more for settlements. This includes both SSRI antidepressant birth defect problems as well as heart issues in adults. A new plaintiff claims that the drug caused the latter.

Cinda McLaughlin says that she developed Paxil heart problems while taking the drug. It forced her to undergo surgery in 2010, with a second following soon after. Interestingly, McLaughlin’s condition is similar to what some expectant mothers have said their infants suffered before they were born. The main difference is that these Paxil side effects led to birth defects, including permanent brain damage and other disabilities.
Still, Ms. McLaughlin will be part of the multidistrict litigation (MDL) in U.S. District Court. Although the conditions are slightly different, Paxil MDL attorneys have already been working on the case and her legal counsel will not have to re-invent the wheel. It also means that the facts of her case will be considered in any potential settlement, unlike a class action lawsuit claim where payouts are restricted. That was the case in Canada, where women received a lower award than their American counterparts for Paxil heart problems.

As the Paxil lawsuits move forward, however, some women may still be unaware of the risks the SSRI antidepressant carries. Product labeling differs regarding Zoloft birth defect side effects and Paxil. While the British Journal of Medicine and other research outlets have noted that all SSRI antidepressants can cause birth defects, the FDA has not issued class-wide requirements. Hopefully psychiatrists will have seen the studies and be able to warn women who want to start a family of these concerns.

Considering the likelihood of depression during pregnancy, choosing among the several other classes of antidepressants can limit the possibility of Zoloft birth defect side effects.
