More Delays for NuvaRing Lawsuits

Lawsuits against NuvaRing have been delayed to the middle of 2013. Plaintiffs who have filed lawsuits against the makers of the vaginal contraceptive ring have been disappointed yet again as they are unlikely to see any significant movement in their claims against Merck. Although there is a possibility that Merck may elect to begin offering NuvaRing lawsuit settlements as opposed to going to trial, there has been no indication thus far that this option is being considered.
The lawsuits against Merck and their NuvaRing device are very similar to the lawsuits against Bayer and their Yaz, Yasmin and Ocella drugs. The oral contraceptive pills and the vaginal ring contraceptive device have both caused patients to develop serious and dangerous side effects, including blood clots. The difference between the two is that Bayer has been working to settle most of their lawsuits outside the court room, while Merck seems to be continually delaying the legal process. While Merck attempts various legal maneuvers, the victims are those that continue to suffer from their serious injuries while waiting for their lawsuit to move forward.
Merck’s Motion for Dismissal Unsuccessful
The pharmaceutical manufacturing giant has filed several motions to have the NuvaRing lawsuits dismissed, but have been unsuccessful so far. Merck has also attempted to make it difficult for plaintiff lawyers to move their NuvaRing injury lawsuits forward, but it is unknown why the company has elected to take this route. Lawyers, plaintiffs and the public question why Merck refuses to attempt NuvaRing settlements, and although it is always possible for a defendant to win their lawsuit, the odds are not in Merck’s favor, according to several legal experts.
While it is common for large companies with stock holders to attempt to settle outside of the court room if it is fairly certain their will not fare well in front of a jury, Merck continues to attempt to block the legal proceedings. Plaintiffs involved in NuvaRing lawsuit against Merck can only hope that the pharmaceutical company will face the music sooner rather than later.
