NuvaRing DVT Lawsuit Alleges Condition Developed within 1 Month
By Andrea Gressman
Details of the NuvaRing DVT Lawsuit
Ms. Dawn Kregel, resident of Denton, Texas, became one of the latest plaintiffs in a string of NuvaRing lawsuits. The NuvaRing lawsuit was filed in the Eastern District of Texas, Sherman Division and listed a number of defendants, including Organon USA Inc., Organon International Inc., Organon Pharmaceuticals USA Inc., Schering-Plough Corp., and Merck & Co. Inc.
The NuvaRing DVT lawsuit claims that the plaintiff used NuvaRing for just a little over a month when she was then diagnosed with DVT. The NuvaRing lawsuit goes on to claim that the manufacturers failed to warn that the birth control implant was known to cause more thrombotic events than the oral birth control pill. The NuvaRing lawsuit states that NuvaRing is marketed as having a lower level of estrogen so that the manufacturer could hide the fact that the device has a higher level of the dangerous third-generation progestin. The plaintiff alleges in her NuvaRing lawsuit that if she would have had all of the facts she would have chosen a different birth control option.
NuvaRing has continually grown in popularity across the United States. It is a vaginal implant ring that provides birth control for a month by providing a continual does of progestin and estrogen for a total of 21 days. The hormones estrogen, ethinyl estradiol, as well as etonogestral are released in combination. The NuvaRing birth control device has been marketed based on the concept that it provides effective birth control just as the oral birth control pill does but the patient does not have to take a daily pill.
NuvaRing Side Effects
There have been hundreds of NuvaRing lawsuits filed to date. Some of these NuvaRing lawsuits have been filed by the victim’s family members in wrongful death lawsuits as the side effects can be that severe. The Food and Drug Administration (FDA) issued a study in October 0f 2011 stating that NuvaRing was linked with a higher side effect rate of deep vein thrombosis and pulmonary embolism compared to the oral birth control pill option.
According to the Mayo Clinic, some of the other side effects associated with NuvaRing include the following:
* Vaginal infection or irritation
* Vaginal secretion
* Increased risk of blood-clotting problems
* Heart attack
* Stroke
* Liver cancer
* Gallbladder disease
* High blood pressure
* Fluid retention
* Breakthrough bleeding or spotting
* Weight gain
* Headache
* Depression
* Nausea
* Breast tenderness
* Decreased sex drive
Many NuvaRing lawsuits have claimed that the NuvaRing has a higher risk of side effects because of the constant stream or progestin and estrogen that the implant device delivers. It is claimed that the liver and the digestive system cannot process the excess hormones so the NuvaRing user receives a higher dose of the hormones than they would with the oral birth control option. That is where the dangerous side effects begin to occur and some of these situations even turn out to be fatal.
Due to the number of NuvaRing birth control lawsuits filed across the United States, a NuvaRing lawsuit MDL (multidistrict litigation) was established. It is currently located in the U.S. District Court, Eastern District of Missouri. The NuvaRing lawsuit MDL began on September 5, 2012 and the NuvaRing MDL currently has over 1000 NuvaRing lawsuits consolidated in it. It is referred to as In re: NuvaRing Products Liability Litigation, MDL No. 1964, JPML, Eastern District Missouri.
