$2.86 Million Asbestos Settlement Awarded to Family of Mesothelioma Victim

The family of a Delaware man who died from mesothelioma cancer has been awarded $2.86 million from RT Vanderbilt Company, Inc., who they say caused his death by exposing him to asbestos fibers. It is the largest asbestos settlement reached against a single defendant in Delaware in over a decade.
The mesothelioma lawsuit settlement was awarded to the family of Michael Galliher of Mansfield, Ohio, a 62-year-old man who worked at Crane Plumbing Fixtures Factory for nearly 40 years. While on the job, he was exposed to asbestos fibers while using talc powder to dust large molds of sinks, bathtubs and other ceramic fixtures. The asbestos fibers came from a New York mine that was operated and owned by RT Vanderbilt. Expert testimony during the asbestos mesothelioma lawsuit trial linked Galliher’s exposure to talc dust containing asbestos fibers to his diagnosis of mesothelioma cancer in August 2010. Galliher died months later on February 3, 2011. A Delaware jury found Vanderbilt 100 percent liable for not listing the proper safety warning on the talc powder.
“The magnitude of Mr. Galliher’s exposure is immeasurable,” said his asbestos attorney. “Like many Americans, he worked hard his entire life so he could enjoy retirement with his grandchildren. Instead, it caused him to be exposed to asbestos and develop a deadly cancer.”
Galliher’s widow said the outcome of the asbestos lawsuit settlement “is not about the money. This is about the fact that a jury has held RT Vanderbilt responsible for its actions. We just hop no other family has to go through the pain and loss we have experienced.”
The mesothelioma settlement is a reminder to companies that they will be held responsible for knowingly using substances containing carcinogens like asbestos without adequate safety warnings.
