Pouring a concrete padAn injured worker recently settled his work accident claim with a $10 million deal. The $10 million settlement was achieved shortly before the worker and the concrete company he worked for were set to go to trial in Illinois State Court.

The basis of the claim argued that the employee driving the truck for Ozinga Ready Mix Concrete was negligently operating a vehicle when he struck the plaintiff. The plaintiff allegedly sustained a devastating impact on his ability to work as a manual laborer because of the injuries he allegedly sustained in the accident. According to the plaintiff, numerous different prosthetics will be required by him to even be able to live a normal life or engage in physical activities in the future.

The plaintiff, who suffered in the accident due to the allegedly negligently operated vehicle, was 26 at the time of the accident and was one of two independent workers who was hired by Muscle Concrete to assist with developing a concrete path at a Chicago property. According to the lawsuit, that worker arrived on the job site and began putting together his tools on the first day of work in October of 2016.

When the driver of the truck pulled in to work site, the vehicle’s path was blocked by the tools that had been unloaded by the worker. At that point, the contractor asked the truck to stop so that the tools could be moved.

According to the lawsuit, however, the truck driver continued to move the truck into the work site while one of the employees was still moving a tool out of the way. This caused significant injuries to the left foot due to a crush injury and led to additional injuries to the thigh as well as scarring. A workplace accident can involve claims against the party that caused the incident as well as an employer of that party as is illustrated in this case.
