18-Wheeler Truck AccidentPlaintiff Terry M. is the latest individual to allege injuries in an 18-wheeler truck accident. She alleges that it was the fault of the operator of the truck.

In the 18-wheeler truck accident lawsuit, the plaintiff alleges that the defendant, Eugene C., was operating a 2010 tractor-trailer owned by Blair Logistics LLC. At the time that the accident occurred, Eugene was travelling eastbound on I-12 in the right travel lane in Louisiana.

Suddenly, however, according to the lawsuit, the tractor trailer changed into the left lane of the road and hit the right side of the 2016 KIA Soul operated by Terry. The lawsuit alleges that this was a violent collision that caused significant injuries to the plaintiff. Terry alleges that her life will never be the same as a result of the injuries she sustained in this preventable accident.

Plaintiff Complaints

Terry argues that she suffered head, left shoulder, thoracic, back, neck, left elbow, bilateral hip, and other injuries as a result of this incident. Terry argues that she has suffered numerous consequences including past, present, and future disability, lost wages, loss of enjoyment of life, mental pain, distress and anguish, and physical pain and suffering.

She also alleges that she had to undergo a 3-level cervical fusion as a result of the injuries she sustained and that the outcome from that surgery means that her functional capacity is significantly limited.

The plaintiff in this 18-wheeler truck accident lawsuit argues that the individual driver, the insurance carrier covering the truck company, and Blair Logistics LLC are responsible and liable for all of the injuries caused. Driver negligence is often the claim in many lawsuits like these.

The lawsuit alleges numerous mistakes and errors made on the part of the driver, including failing to maintain the vehicle in proper working condition, failing to keep the vehicle at an appropriate speed under the circumstances, failing to maintain the vehicle under control, failing to stop, driving in a careless and reckless manner, and failing to keep a proper lookout.

The lawsuit alleges that the female plaintiff has had to suffer significant problems and pain directly related to her injuries and that she will not be able to live her life normally as she did prior to the incident as a result of the careless and reckless behaviors that ultimately caused the trucking accident.

According to the Insurance Institute for Highway Safety, Highway Loss Data Institute, the majority of fatalities in large truck crashes are occupants inside passenger vehicles. This is attributed to the fact that trucks often weigh as much as 30 times more than passenger vehicles.

An overall decrease in roadway fatalities was reported in 2017, but the National Highway Traffic Safety Administration has recently shared that large truck occupant fatalities have increased significantly in 2018.
