A deadlyn pickup truck accident claimed the lives of seven . members of motorcycle group.A U.S. Marine Corps veteran seriously injured in a pickup truck accident that claimed the lives of seven other motorcyclists has filed a lawsuit against the truck’s driver.

USA Today reported that Joshua Morin suffered substantial injuries when a truck drove into a group of bikers along a New Hampshire highway in June. Morin’s injuries, according to the newspaper, included “a left femur fracture; a compound fracture of his left tibia and left fibula bones; injuries to his left knee, ankle and shoulder; contusions and abrasions; and road rash on parts of the left side of his body.”

Seven of the nine motorcycle riders in the group died in the wreck. Criminal charges have been filed against 23-year-old Volodymyr Zhukovskyy, the truck’s driver, in connection with the deaths.

According to CBS News, Zhukovskyy has pleaded not guilty.  Fox News reported that U.S. Immigration and Customs Enforcement (ICE ) has placed a detainer  on Zhukovskyy, who is a native of Ukraine.

The suit also accuses his employer, Westfield Transport, of negligence for employing a driver who had drunk driving charges on his record. It’s anticipated that other suits are forthcoming.

Morin is seeking damages for medical expenses, personal injuries, lost wages, mental pain and anguish, and pain and suffering. His wife also has a claim for  loss of consortium.

Zhukovskyy has a lengthy record of traffic, drug and alcohol infractions in six states, including DUI. Morin’s suit accuses Zhukovskyy of failing to safely operate his vehicle and keep it on the proper side of the highway, in addition to failing to use due care and failing to keep a proper lookout.

The Marine Times reported that the Dodge pickup Zhukovskyy was driving was towing a flatbed trailer when it collided with the motorcyclists. Zhukovskyy was reportedly driving erratically before crossing the center line.

Morin’s atorney told USA Today that he plans to add the Massachusetts Registry of Motor Vehicles as a defendant in the suit for its alleged negligence for failing to process “tens of thousands of out-of-state traffic infractions that were mailed in from other states, including hundreds of drunken-driving charges.”

It is estimated that at least a few hundred of the citations were for drunk driving and would have shown up on Zhukovskyy’s record had the agency done its job.

Morin’s lawyer said he anticipates his client’s medical expenses will be at least $500,000, though he cautions that the full extent of the injuries is not yet known. In motorcycle accidents, the injuries can be severe in nature and can cause lifelong disabilities and issues.
