Two semi trucks in a yardAmong recent truck accidents, a Texas resident says she and her child were injured in an wreck allegedly caused by a semi driver.

Plaintiff Caroline V. Says that she was driving a 2006 Ford Expedition westbound in her home state of Texas on November 12, 2018, when she was hit by Walter D., who was allegedly driving for his employer NR 1 Transport Inc.

Caroline alleges the accident occurred because of negligence on the part of Walter. Caroline aims to hold Walter and his employer responsible for her and her daughter’s injuries that she claims were caused by the accident.

According to the lawsuit, when the truck accident occurred, Walker was operating a 2016 Red Freightliner tractor and towing a 2016 white Hyundai trailer. Caroline says Walter disregarded a red light and failed to yield to her, causing a collision between the driver’s side of his tractor truck and the front of Caroline’s vehicle.

Caroline claims that as a result of the impact, she suffered injuries to her low back, upper back, chest, right elbow, bilateral wrist, bilateral leg, and her neck. She says that her daughter, Tamara, who is a minor and was traveling with her in the car at the time of the accident, suffered injuries to her neck, upper back, mid back. Allegedly, Tamara still suffers from headaches.

According to the Texas truck accident lawsuit, the collision was caused by negligence by the truck driver — negligence is a cause of many recent truck accidents like Caroline’s.

These accidents can have serious effects, and recent truck accidents are a sad testimony to this. However, there can be many causes of truck accidents. Fox19 reports that in Indiana, twenty two people were injured in a collision involving a school bus and a trash truck. Twenty of the people injured were children aboard the school bus.  

In another case, The Kansas City Star reports that recent truck accidents included a “massive” pileup involving semis, cars, and other trucks. 

In her Texas truck accident lawsuit, Caroline alleges that Walter was negligent in a number of ways and is responsible for causing the accident.

Caroline says that Walter failed to keep a proper lookout for other traffic “as a reasonable and prudent person would have done under the same or different circumstances.” She also alleges that he failed to safely operate the vehicle, failed to maintain proper control, apply the brakes appropriately, and failed to take evasive actions to avoid the collisions.

Allegedly, he also failed to control the speed of his vehicle and stop appropriately. She says that he also failed to obey a traffic sign by failing to stop.

According to the Texas NR 1 Transport Inc. lawsuit, each of these acts or failures “was a separate and distinct act of negligence and each was a direct and proximate cause of the injuries and damages suffered by [Caroline and Tamara].”

Caroline aims to hold Walter and NR 1 Transport Inc. accountable for her injuries because Walter was operating the tractor during the course of his employment with NR 1 Transport Inc. She seeks damages to compensate for her and her daughter’s injuries. Allegedly, they were physically, emotionally, and financially injured by the accident.

The Texas NR 1 Transport Inc. Lawsuit is Case No. 5:19-cv-00031, in the U.S. District Court for the Southern District of Texas, Laredo Division.
