Werner Enterprises Lawsuit Claims Semi Driver Negligence Caused CrashA recent Werner Enterprises lawsuit claims that a company semi driver was operating his vehicle negligently, leading to an accident and injuries.

Plaintiff Bennett S. filed a lawsuit against Werner Enterprises and a company driver after a semi truck accident allegedly left him severely injured. Bennet alleges he was driving his 2011 Dodge Nitro in Georgia and was attempting to make a left hand turn with a green arrow when defendant Anthony K. allegedly struck his vehicle while driving a Werner Enterprises truck. Anthony, the driver, allegedly failed to obey the traffic control signal which told him to stop, resulting in a collision with the driver side of Bennett’s vehicle.

The Werner Enterprises lawsuit claims that the accident was a result of Anthony’s negligence including failure to obey a traffic control, failing to keep his motor vehicle under proper control, and failure to pay proper attention to the traffic conditions around him.

“As a result of the aforesaid acts of combined negligence on the part of all defendants based upon the aforesaid acts of negligence, [Bennett] has suffered serious injury to his body,” the Werner enterprises lawsuit states.

Bennett says he suffered from two broken wrists, a broken shoulder blade, broken ribs, pain in his injured areas, possible concussion, sleep disturbance, lightheadedness, and dizziness. Treatment of these injuries allegedly racked up significant medical bills totaling over $28,000 across ten hospitals and treatment facilities.

Additionally, the Werner Enterprises lawsuit claims that Bennett sustained further economic injury due to his inability to work. Bennett claims that he incurred lost wages of $7,700 and travel expenses of over $5,000. The Werner Enterprises lawsuit seeks damages and judgment against the defendants.

Due to the size of semi trucks, accidents involving these vehicles can cause serious injuries or be deadly. Because these vehicles are so much larger than passenger cars, they present an even greater hazard in a collision. In fact, 98 percent of casualties from semi truck accidents are in smaller vehicles. This means that regular drivers are often the ones who suffer from semi truck accidents, even if it was not their fault.

A variety of factors can contribute to a semi truck accident including: driver fatigue, lack of driver training, lack of experience, alcohol use, drug use, unsafe equipment, lack of maintenance, weight imbalances, high speeds, brake problems, cell phone usage, distracted driving, road and weather conditions, and violations of federal trucking laws and regulations.

In the wake of a car accident, most people are not worried about legal action. Car accidents, especially those involving large vehicles like semi trucks, can result in serious injuries and even death.
