truck accident lawsuitA man from Tennessee has recently filed a truck accident lawsuit, alleging that Morgan Van Lines Inc. and one of their truck drivers are responsible for a major collision that caused him serious injuries.

Along with the trucking company, driver Otis Williams Jr. has been named as a defendant in this truck accident lawsuit that alleges his negligent action had been the direct cause of the crash.

Plaintiff Shunder S. filed this truck accident lawsuit alleging the collision was completely avoidable, and that the Morgan Van was supposed to ensure that Williams was driving in a safe manner.

According to the truck accident lawsuit, Shunder had been a passenger in a vehicle operated by a different person and had no control over either vehicle at any point before, during, or after the accident.

The truck accident lawsuit states that he and driver Felicia F. were traveling westbound in the left lane on Giacosa Place in Memphis, Tenn. on Oct. 13, 2017. On this day, Shunder says Felicia had been driving in her lane in a safe manner and was exercising reasonable caution while driving.

Williams, however, was allegedly driving westbound; he was in the right lane of the same road and allegedly merged into the claimant’s lane without warning. According to the truck accident lawsuit, Williams failed to notice Shunder and Felicia in the parallel lane and collided into them.

Shunder and Felicia’s vehicle was overtaken by the truck, which reportedly caused the claimant to suffer numerous serious injuries including neck pain, back pain, shoulder pain, and radiating pain in the lower extremities. Shunder is currently contending with the long term effects of these injuries, which have reportedly impacted his quality of life.

Shunder has also reportedly lost work and wages, while incurring expensive medical bills for treatment needed from the accident. He is seeking a multitude of damages in his truck accident lawsuit, including compensation for these missing wages. Like Shunder, victims of truck accidents can often seek compensation.

Overview of Truck Accident Statistics

While Shunder’s injuries are significant, many truck accident victims are often left with much worse injuries and some fatalities. There are approximately 500,000 truck accidents that occur across the United States every year, over 100,000 of which involve serious injuries, and 5,000 cases that are fatal.

It is important to note that over the past 20 years, the number of truck accidents have increased by 20 percent, with one in eight traffic fatalities linked to 18 wheelers. Truck drivers normally escape with little to no injuries; 98 percent of the fatalities in these accidents will be passengers or drivers in typical passenger cars.

There are a number of factors that can contribute to truck accidents, including uncontrollable circumstances like bad weather conditions or preventable acts of negligence like aggressive driving or deadlines. Other factors that can contribute to truck accidents include, but are certainly not limited to:

  • Driver Fatigue
  • Lack of Truck Driving Experience
  • Inadequate Truck Maintenance
  • Brake Problems
  • Driving Under the Influence
  • Talking or Texting on a Cellphone
  • Negligible Driving Behavior

In the case of this truck accident lawsuit, Williams allegedly failed to properly look and pay attention to his surroundings and ultimately collided with Shunder and Felicia’s vehicle.
