Volkswagen agreed to a class action lawsuit settlement to resolve claims that certain Atlas vehicles are equipped with a defective second row seat latch.
The Volkswagen Atlas class action settlement benefits current and former owners and lessees of model year 2018 to 2024 Volkswagen Atlas vehicles.
Plaintiffs in the class action lawsuit claim that certain Volkswagen Atlas vehicles have a defective second row seat latch. This defect allegedly causes the second row seat to become unlatched while driving, posing a risk of injury to passengers.
Volkswagen is an automotive manufacturer that sells vehicles under several brands, including Volkswagen, Audi, Porsche, Lamborghini, Bentley, Bugatti, SEAT, Å koda and Scania.
Volkswagen has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the seat latch defect class action lawsuit.
Under the terms of the Volkswagen Atlas class action settlement, class members can receive a warranty extension, an owner’s manual insert and instructional video and reimbursement for out-of-pocket expenses.
Effective May 21, 2025, the New Vehicle Limited Warranty will be extended to cover 10 years or 100,000 miles of service. This warranty will cover repairs or replacements of malfunctioning second row seat latching mechanisms.
The Volkswagen Atlas seat latch class action lawsuit settlement also provides an owner’s manual insert and an instructional video showing how to properly latch the second row seat in Atlas vehicles.
Class members can receive reimbursement for out-of-pocket expenses related to the second row seat latch defect. The settlement allows for 100% reimbursement for one repair or replacement of a malfunctioning second row seat latching mechanism. Repairs must have been completed within 10 years or 100,000 miles of the vehicle’s in-service date.
If the repair was not performed by an authorized Volkswagen dealer, reimbursement will be capped at $645 for seat latches and $1,700 for second row seats and/or seat frames.
The deadline for exclusion and objection is July 7, 2025.
The final approval hearing for the Volkswagen Atlas class action settlement is scheduled for Aug. 27, 2025.
To receive settlement benefits, class members must submit a valid claim form by Aug. 4, 2025.
